These Terms and Conditions (“Terms”) govern your access to and use of the PocketPDF application, website, software, and related services (collectively, the “Platform”), operated by HouseofTech Innovation Pvt Ltd (“we”, “us”, “our”, or the “Company”).

By accessing, downloading, registering, or using the Platform, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.

1. About the Platform

PocketPDF is a pocket PDF toolkit. It lets you import, read, and organise PDF documents into folders with bookmarks; merge, split, reorder, rotate and remove pages; compress files; convert photos and camera scans into PDFs; add stamps, watermarks and page numbers; annotate documents, fill forms, and sign; and export or share the result. Reading and library management are free and work offline. Editing tools, cloud backup & sync, and Ask AI are part of PocketPDF Pro, a paid subscription with multiple plan options and usage limits described in our Payment & Cancellation Policy.

2. A Tool, Not Professional Advice or Certification

• We do not verify the authenticity, ownership, contents, or legal effect of any document you import, edit, sign, or share.
• Requirements for a valid electronic signature differ by country, document type, and counterparty (for example under the Indian Information Technology Act 2000, the EU eIDAS Regulation, or the US ESIGN Act). Confirm with your own advisor that a signature applied in the App meets the rules that apply to you.
• PocketPDF is not legal, financial, medical, tax, or other professional advice, and is not a substitute for a qualified professional.
• Features, tools, and limits may be updated, replaced, or removed at any time, and may vary by region, device, plan, build, and server load. Some features depend on your device’s capabilities and may not be available on every device or platform.

3. Ask AI — Accuracy Disclaimer

• Ask AI runs only when you select a document and submit a request. It processes extracted text (currently up to approximately 24,000 characters per request) — long documents may therefore be summarised only in part.
• Documents with no extractable text (for example image-only scans, unless text recognition is available and enabled in your build) cannot be analysed.
• Ask AI requests are subject to fair-use limits, which may be adjusted to keep the service available to all users.
• We are not liable for any action taken, or not taken, on the basis of AI output.

4. Eligibility

• You must be at least 13 years old to use the App, and at least 18 years old (or the age of majority where you live) to purchase a subscription, or have the consent of a parent or guardian.
• By using the Platform you confirm you have the legal capacity — and, where you act for a business or employer, the authority — to accept these Terms.

5. Account Registration

• You can import and read documents without an account. An account is required to subscribe, to use cloud backup & sync, and to use Ask AI.
• You register using your mobile number and a one-time password (OTP) sent to it. There is no separate password.
• You are responsible for keeping your mobile number and device secure and for all activity under your account. Tell us immediately if you lose control of the number or device linked to your account.
• You agree to provide accurate and complete information, and to use a mobile number you are entitled to use.
• We may suspend or terminate accounts with false, misleading, or shared credentials.

6. Your Content

• Documents you import, and the annotations, signatures, stamps, form entries, bookmarks and folders you create (“Your Content”) remain yours. We claim no ownership over them.
• Your Content is stored on your device. It is transmitted to us only when you choose to back a document up to the cloud, or when you use Ask AI on it.
• For those features only, you grant us a limited licence to host, store, process, and transmit Your Content solely to provide the requested feature to you. We do not use Your Content for advertising, and we do not use it to train AI models.
• You confirm that you own Your Content or otherwise have the right to import, edit, sign, store, and share it, including where it contains another person’s personal data or third-party intellectual property.
• You are responsible for keeping your own copies of documents you cannot afford to lose. Documents held only on your device and not backed up cannot be recovered by us if the device is lost, reset, or the App is uninstalled.

7. Our Content & Your Licence to Use the App

• All software, design, layout, branding, text, icons, and graphics forming part of the App (the “Content”) are owned by or licensed to HouseofTech Innovation Pvt Ltd and are protected by intellectual-property laws.
• We grant you a limited, non-exclusive, non-transferable, revocable licence to use the App for your own personal or internal business purposes, while your account and (where applicable) subscription are active.
• Documents you produce are yours to use, including commercially. You may not resell, redistribute, or sublicense the App itself or your subscription, or build a competing product from it.
• The App includes open-source components, which remain governed by their own licences.

8. Acceptable Use & Restrictions

You agree not to:

• Use the App to forge, falsify, backdate, or tamper with documents, to impersonate any person or organisation, or to apply another person’s signature without their authority.
• Import, edit, or distribute documents you have no right to handle, or use the App to infringe copyright or other third-party rights.
• Use the App to remove or circumvent password protection, encryption, digital rights management, or other technical protection on a document you do not own or are not authorised to unlock.
• Upload or process personal data of individuals where you have no lawful basis to do so.
• Use Ask AI to generate unlawful, deceptive, or harmful content, or to attempt to extract data belonging to other users.
• Resell, sublicense, or commercially redistribute the App or your subscription, or provide access to third parties via automation or scraping.
• Reverse engineer or attempt to extract source code or proprietary systems.
• Circumvent usage limits, quotas, paywalls, or entitlement checks, or share a subscription across multiple people.
• Attempt to access another user’s account, documents, or backups.
• Upload malware, or files designed to disrupt, overload, or exploit the Platform or its infrastructure.
• Use the Platform for any unlawful, abusive, or harmful purpose.

9. Subscription, Pricing & Payments

• PocketPDF Pro is offered through paid subscription plans (currently monthly and yearly, with introductory or trial offers from time to time), and may include one-time in-app purchases.
• Current pricing and plan limits are displayed inside the App at the time of purchase, in your local currency where supported. Prices may vary by region and may change at any time; existing active subscriptions remain at the agreed price until renewal.
• Payments are processed by RBI-licensed payment gateway partners (such as Razorpay, PhonePe, or similar providers), supporting UPI & UPI Autopay, credit/debit cards, and netbanking. The active payment gateway may change from time to time without prior notice.
• We do not store your full card or banking details on our servers.
• Subscriptions auto-renew until cancelled. See our Payment & Cancellation Policy for full details.
• Prices may be inclusive or exclusive of taxes (GST, VAT, sales tax) depending on your region; any applicable taxes are shown at checkout.

10. Usage Limits & Fair Use

• Free and paid plans carry limits — for example on which tools are unlocked, on the amount of document text sent to Ask AI per request, on the number of AI requests, and on cloud backup storage and file size. Current limits are shown in the App.
• We may set, adjust, or enforce these limits to keep the service reliable and affordable, and to prevent abuse. Material reductions affecting an active paid plan will be notified in advance.
• Automated, bulk, or commercial-scale processing beyond normal individual use may be throttled or suspended.

11. Refund & Cancellation

• You may cancel auto-renewal at any time before the next billing cycle. Cancellation prevents future charges; current period access continues until expiry.
• Completed payments are non-refundable except as described in our policy or where required by applicable consumer law (including any statutory withdrawal/cooling-off rights in your country).

12. Disclaimer

• The Platform is provided on an “as is” basis and is not guaranteed to produce documents that are accurate, complete, or legally sufficient for any particular purpose or jurisdiction.
• PDF processing can alter layout, fonts, embedded objects, form fields, or file size. Always check the output before relying on or sending it. Keep the original until you have verified the result.
• Compression, flattening, and page operations may be irreversible in the produced file. We are not liable for loss of quality, formatting, or content in files you generate or overwrite.
• We do not guarantee that a document, signature, or stamp created with the App will be accepted by any court, authority, bank, employer, or counterparty.

13. Service Availability & Data

• We aim for continuous availability but do not guarantee uninterrupted access. Maintenance, updates, or outages at our infrastructure or AI providers may temporarily affect the service.
• Cloud backup is a convenience feature, not a guaranteed archive. We take reasonable measures to protect stored data, but you should keep your own copies of critical documents.
• If a backup conflict occurs (for example the same document changed on two devices), the App may ask you to resolve it. We are not liable for content lost through a conflict you resolve.

14. Third-Party Services

• The Platform integrates third-party services such as Google Cloud (application hosting and object storage), SMS/OTP delivery providers, large-language-model providers for Ask AI, payment gateways (Razorpay, PhonePe), and analytics tools.
• These services operate under their own terms and privacy policies. We are not responsible for their independent functionality or policies.

15. Suspension & Termination

We may suspend or terminate your account if:

• You violate these Terms, our usage rules, or applicable law.
• You use the App to forge, falsify, or unlawfully unlock documents.
• Payments fail, are disputed, or charged back.
• You misuse the App in ways that harm other users or the Platform.
• Required by court order or government authority.

Where lawful and practical, we will give you a reasonable opportunity to restore or export your cloud-backed documents before termination takes effect. Documents stored locally on your device are unaffected by account termination.

16. Limitation of Liability

To the maximum extent permitted by law:

• The Platform is provided on an “as is” and “as available” basis.
• We do not guarantee uninterrupted, error-free, or always-accurate service.
• We are not liable for any indirect, consequential, or incidental damages, or for loss of profit, revenue, business, goodwill, or data — including loss or corruption of documents, rejection of a signed document, or any decision made on the basis of AI output.
• Our total aggregate liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.
• Nothing in these Terms excludes liability that cannot be excluded under applicable law, or limits any non-waivable statutory consumer rights in your country of residence.

17. Indemnification

You agree to indemnify and hold harmless HouseofTech Innovation Pvt Ltd, its officers, employees, and partners from any claims arising from:

• Your use or misuse of the Platform
• Documents you import, edit, sign, store, or share, and their contents
• Your handling of any third party’s personal data or intellectual property
• Your violation of these Terms
• Your infringement of any third-party right

18. Privacy Policy

Your use of PocketPDF is also governed by our Privacy Policy, which explains how your data and documents are handled.

19. Modifications to Terms

• We may update these Terms at any time. Material changes will be communicated through the App.
• Continued use of the Platform after updates means you accept the revised Terms.

20. Governing Law & Jurisdiction

• These Terms are governed by the laws of India, without prejudice to any mandatory consumer-protection rules of the country where you habitually reside.
• Subject to such mandatory rules, disputes shall fall under the exclusive jurisdiction of courts in Gurgaon, Haryana, India.
