These Terms and Conditions (“Terms”) govern access to and use of the ColorJoy mobile application, website, software, and related services (collectively, the “Platform”), operated by HouseofTech Innovation Pvt Ltd (“we”, “us”, “our”, or the “Company”).

1. About the Platform

ColorJoy is a digital colouring book for children. It offers a library of hand-drawn colouring pages across categories such as animals, alphabets, fairytales, mandalas, nature, and vehicles. A child taps an area of a picture to fill it with a colour from a palette, can undo and redo, and can save finished artwork to a personal gallery on the device. The App offers two age modes (“Little Kids” and “Big Kids”) that adjust the palette and page complexity. Some template packs are free; other packs and features require a paid subscription.

2. Who May Use ColorJoy — Children & Parents

• ColorJoy is designed for children of roughly 3 to 12 years old, to be used with the knowledge and permission of a parent or legal guardian.
• You must be 18 or older (or the age of majority where you live) to accept these Terms, create any account, or make any purchase. By doing so, you confirm you are the parent or legal guardian of the child using the App, and that you have the legal capacity to accept these Terms.
• Children may use the colouring features without an account and without providing any personal information. Accounts, sign-in, and purchases are for parents only, and are placed behind a parental gate.
• You are responsible for supervising your child’s use of the App and for any activity that takes place under your account.

3. Parental Gate

• Actions intended for adults — signing in, subscribing, and managing the account — are protected by a parental gate (a simple question a young child is unlikely to answer).
• The parental gate is a safeguard, not a guarantee. It does not replace adult supervision. Please keep your device passcode, app-store password, and payment authentication private, so that a child cannot make purchases without your knowledge.

4. Device Permissions

• ColorJoy requests only internet access. It does not request or use the camera, microphone, photo gallery, storage, contacts, or location.
• ColorJoy contains no third-party advertising and no social-media sharing features.

5. Accounts

• An account is optional. Most of the App works without one.
• A parent may sign in with a supported identity provider (Google) to sync a child’s gallery across devices and to manage a subscription.
• You are responsible for the security of your account credentials and for all activity under your account.
• You agree to provide accurate and complete information, and we may suspend or terminate accounts with false, misleading, or shared credentials.

6. Your Child’s Artwork

• Artwork your child creates in ColorJoy belongs to your family. We claim no ownership of it.
• If you enable cloud gallery, you grant us a limited licence to store and transmit that artwork solely to sync and restore it for you, and to review it for safety as described in our Privacy Policy.
• Artwork is created from our own templates and palette; the App provides no way to import a photograph or enter free text beyond a title.
• We do not use your child’s artwork to train artificial-intelligence models, and we do not publish, sell, or share it.

7. Content Ownership & Your Use

• All colouring pages, templates, artwork, illustrations, palettes, characters, graphics, software, design, and branding in the App (the “Content”) are owned by or licensed to HouseofTech Innovation Pvt Ltd or their respective rights holders, and are protected by intellectual-property laws.
• We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Content for your family’s personal, non-commercial enjoyment, while your subscription (where applicable) is active.
• You may not resell, redistribute, sublicense, print for sale, or create derivative works from the Content itself, or use it commercially, without our written permission. Printing a page for your own child at home is fine.

8. Acceptable Use & Restrictions

You agree not to:

• Resell, sublicense, or commercially redistribute the App, the Content, or your subscription.
• Reverse engineer or attempt to extract source code or proprietary systems.
• Circumvent usage limits, paywalls, the parental gate, or content protections.
• Use the Platform for any unlawful, fraudulent, abusive, or harmful purpose, or to store content that is unlawful or harmful to children.
• Share your account or active subscription with others outside your household.

9. Subscription, Pricing & Payments

• Premium template packs and features are available through a paid subscription, purchased by a parent.
• Current pricing is displayed inside the App at the time of purchase, in your local currency where supported. Prices may vary by region and may change; existing active subscriptions remain at the agreed price until renewal.
• Payments are processed by RBI-licensed payment gateway partners (such as Razorpay, PhonePe, or similar providers), supporting UPI & UPI Autopay, credit/debit cards, and netbanking. The active payment gateway may change from time to time without prior notice.
• Subscriptions auto-renew until cancelled. See our Payment & Cancellation Policy for full details.
• Prices may be inclusive or exclusive of taxes (GST, VAT, sales tax) depending on your region; applicable taxes are shown at checkout or applied by the app store.

10. Refund & Cancellation

• You may cancel auto-renewal at any time before the next billing cycle. Cancellation prevents future charges; access continues until the current period expires.
• Purchases made by a child without your permission: if this happens, contact the app store promptly — both Google and Apple operate refund processes for unauthorised purchases — and contact us and we will help. See the Payment & Cancellation Policy.

11. Disclaimer

• ColorJoy is an entertainment and creativity app. It is not an educational, developmental, diagnostic, or therapeutic product, and we make no claim that it delivers any particular learning or developmental outcome.
• The App is not a substitute for adult supervision. You remain responsible for how long and how your child uses the device.
• Content is provided on an “as is” basis.

12. Intellectual Property & Third-Party Rights

• All software, design, branding, and Content on the Platform are owned by or licensed to HouseofTech Innovation Pvt Ltd or their respective rights holders.
• You receive a personal-use licence only; no ownership of the Platform or Content transfers to you.
• ColorJoy’s colouring pages are original or licensed works and are not affiliated with, endorsed by, or sponsored by any brand, studio, or character franchise unless expressly stated.
• If you are a rights holder and believe content infringes your rights, contact us at the email below and we will review and, where appropriate, remove it.

13. Third-Party Services

• The Platform integrates Google Firebase (hosting, database, storage), Google Sign-In (optional), and payment gateways (Razorpay, PhonePe).
• These services operate under their own terms and privacy policies. We are not responsible for their independent functionality or policies.
• The Platform integrates no advertising networks and no analytics SDKs.

14. Suspension & Termination

We may suspend or terminate your account if:

• You violate these Terms or applicable law.
• Payments fail, are disputed, or are charged back.
• The App is misused in ways that harm other users, children, third parties, or the Platform.
• Required by court order or government authority.

15. Limitation of Liability

To the maximum extent permitted by law:

• The Platform is provided on an “as is” and “as available” basis.
• We do not guarantee uninterrupted or error-free service.
• We are not liable for any indirect, consequential, or incidental damages, or for loss of locally stored artwork (which lives on your device and is not backed up by us unless you enable cloud gallery).
• Our total aggregate liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.
• Nothing in these Terms excludes liability that cannot be excluded under applicable law, or limits any non-waivable statutory consumer rights in your country of residence.

16. Indemnification

You agree to indemnify and hold harmless HouseofTech Innovation Pvt Ltd, its officers, employees, and partners from any claims arising from:

• Your or your child’s use or misuse of the Platform or its Content
• Your violation of these Terms
• Your infringement of any third-party right

17. Privacy Policy

Use of ColorJoy is also governed by our Privacy Policy, which explains what we collect, how children’s data is protected under COPPA, GDPR, and India’s DPDPA, and how a parent can review or delete it.

18. Modifications to Terms

• We may update these Terms at any time. Material changes will be communicated in the App.
• Continued use of the Platform after updates means you accept the revised Terms.

19. Governing Law & Jurisdiction

• These Terms are governed by the laws of India, without prejudice to any mandatory consumer-protection rules of the country where you habitually reside.
• Subject to such mandatory rules, disputes shall fall under the exclusive jurisdiction of courts in Gurgaon, Haryana, India.
