These Terms and Conditions (“Terms”) govern your access to and use of the Topper mobile application, website, software, and related services (collectively, the “Platform”), operated by HouseofTech Innovation Pvt Ltd (“we”, “us”, “our”, or the “Company”).

By accessing, downloading, registering, or using the Platform, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.

1. About the Platform

Topper is an AI-powered homework help app for school students. A student can type a question, scan or photograph a homework problem, or (where enabled) ask by voice, and Topper returns a step-by-step explanation, worked solution, or study guidance across subjects such as maths, science, social studies, and languages. Some subjects, features, and usage limits are free; others require a paid subscription or in-app purchase.

2. The Nature of AI Answers — Please Read

• Answers are provided on an “as is” basis for learning and self-study. We do not warrant that any answer is accurate, complete, curriculum-aligned, or suitable for any particular purpose, and we do not guarantee any academic result, grade, or exam outcome.
• The quality and availability of answers may vary by subject, class/grade, board or curriculum, language, region, device, plan, and server load.
• Subjects, features, and usage limits may be updated, replaced, or removed at any time.
• Topper is not designed to give medical, psychological, legal, or financial advice, and must never be relied on in an emergency. If a child needs help, please contact a qualified professional or your local emergency services.
• If your child receives a wrong or inappropriate answer, please report it from within the App or email us so we can fix it.

3. Academic Honesty

• Topper is built to explain how to reach an answer so a student learns the method — not to do their work for them.
• You agree not to use Topper during any examination, test, or assessment, or in any other way that breaches your school’s or board’s rules on academic honesty, plagiarism, or permitted assistance.
• Schools and boards set their own rules. You are responsible for knowing and following them, and we are not responsible for any academic penalty arising from misuse of the App.

4. Eligibility, Parental Consent & Supervision

• Topper is intended for school students, used with the knowledge, consent, and supervision of a parent or legal guardian.
• A user under 18 (or the age of majority where they live) may not create an account, subscribe, or make any purchase. Accounts and purchases are reserved for a parent or guardian and sit behind a parental gate.
• By creating an account, you confirm that you are 18 or older (or the age of majority where you live), that you have the legal capacity to accept these Terms, and that you are the parent or legal guardian of the child who will use the App — and you consent to the processing of your child’s data as described in our Privacy Policy.
• We recommend that a parent stays aware of how their child uses Topper and reviews answers with them, particularly for younger children.

5. Account Registration

• Parts of the App may be usable without an account; to save question history, track progress, or subscribe, a parent may sign up using a mobile number (OTP), email address, or a supported identity provider (Google, Apple).
• You are responsible for the security of your account credentials and for all activity under your account, including your child’s.
• You agree to provide accurate and complete information.
• We may suspend or terminate accounts with false, misleading, or shared credentials.

6. Device Permissions

• To read and answer a homework question, the App may request permissions such as the camera (optional, only when your child chooses to scan a question), photos/media access (to pick an existing image and save answers), the microphone (optional, only while asking a voice question), storage, and notifications.
• These permissions are used only to deliver the features requested. You may revoke them from your device settings, though some features (such as scanning a question) will then be unavailable.

7. Your Content & What You Submit

• You retain ownership of the questions, text, images, and voice input your child submits (“Your Content”). You grant us a limited licence to process Your Content only to generate, save, and deliver the explanation requested, and to review a limited sample for answer quality and safety as described in our Privacy Policy.
• We do not permit Your Content to be used to train third-party AI models.
• Please submit only the homework question. Do not submit images or text containing faces, personal details of any child, addresses, ID documents, report cards, or other sensitive information — Topper does not need them.
• You confirm that you have the right to submit any image or text, and that doing so does not infringe anyone’s rights (including a publisher’s copyright in a textbook) or violate any law. You are solely responsible for what is submitted.
• You must not use the App to submit or generate content that is unlawful, hateful, obscene, defamatory, harassing, or that impersonates or misuses another person’s identity or image.

8. Content Ownership & Your Use

• All software, models, prompts, lessons, worked solutions, explanations, design, branding, and other materials made available in the App (the “Content”) are owned by or licensed to HouseofTech Innovation Pvt Ltd or their respective rights holders, and are protected by intellectual-property laws.
• We grant you a limited, non-exclusive, non-transferable, revocable license to use the Content for your family’s own personal, non-commercial study, while your account and (where applicable) subscription are active.
• You may not resell, redistribute, sublicense, publish, or create derivative works from the Content, or use it to build a competing service, to build a question bank or dataset, or to train any AI model, without our written permission.

9. Acceptable Use & Restrictions

You agree not to:

• Resell, sublicense, or commercially redistribute the App, the Content, or your subscription, or provide access to third parties via automation, bots, or scraping.
• Use the App to run a tuition, coaching, or answer-selling service, or to answer questions on behalf of others at scale.
• Reverse engineer or attempt to extract source code, models, prompts, or proprietary systems.
• Circumvent usage limits, paywalls, parental gates, geo-restrictions, or content protections.
• Use the Platform for any unlawful, fraudulent, abusive, or harmful purpose, or to generate content that promotes hatred, self-harm, or harm to any person or community.
• Attempt to make the App produce content that is unsafe or inappropriate for children.
• Share your account or active subscription with people outside your family.

10. Subscription, Pricing & Payments

• Premium subjects, features, and higher usage limits are available through paid subscription plans and/or one-time in-app purchases, bought by a parent or guardian.
• Current pricing is displayed inside the App at the time of purchase, in your local currency where supported. Prices may vary by region and may change at any time; existing active subscriptions remain at the agreed price until renewal.
• Payments are processed by licensed payment gateways — primarily Razorpay and PhonePe — supporting UPI, credit/debit cards, net banking, and wallets. The active gateway may change without prior notice.
• We do not store your full card, UPI, or banking details on our servers.
• Subscriptions auto-renew until cancelled. See our Payment & Cancellation Policy for full details.
• Prices may be exclusive of taxes (VAT, GST, sales tax) depending on your region; any applicable taxes are shown at checkout.

11. Refund & Cancellation

• You may cancel auto-renewal at any time before the next billing cycle. Cancellation prevents future charges; current period access continues until expiry.
• Completed payments are non-refundable except as described in our policy or where required by applicable consumer law (including any statutory withdrawal/cooling-off rights in your country). See the Payment & Cancellation Policy.

12. Disclaimer

• Topper provides AI-generated study help. Content is provided on an “as is” basis and is not guaranteed to be accurate, complete, curriculum-aligned, or suitable for any particular purpose.
• We do not guarantee any academic outcome, grade, rank, or exam result.
• You are solely responsible for how the App is used, including verifying answers before relying on them and complying with your school’s rules and the laws of your jurisdiction.

13. Intellectual Property & Third-Party Rights

• All software, models, design, branding, and Content on the Platform are owned by or licensed to HouseofTech Innovation Pvt Ltd or their respective rights holders.
• You receive a personal-use license only; no ownership of the Platform or Content transfers to you.
• Topper is an independent app and is not affiliated with, endorsed by, or certified by any school, board, examination authority, university, or publisher unless expressly stated. References to boards or curricula are for identification only.
• If you are a rights holder and believe content infringes your rights, contact us at the email below and we will review and, where appropriate, remove it.

14. Third-Party Services

• The Platform integrates third-party services such as payment gateways (Razorpay, PhonePe), sign-in and OTP providers (Google, Apple, SMS gateways), cloud storage, AI/model inference, speech-to-text and image-recognition infrastructure, content-delivery networks, and analytics tools.
• These services operate under their own terms and privacy policies. We are not responsible for their independent functionality or policies.

15. Suspension & Termination

We may suspend or terminate your account if:

• You violate these Terms, our usage rules, or applicable law.
• Payments fail, are disputed, or charged back.
• The App is misused in ways that harm children, other users, third parties, or the Platform.
• Required by court order or government authority.

16. Limitation of Liability

To the maximum extent permitted by law:

• The Platform is provided on an “as is” and “as available” basis.
• We do not guarantee uninterrupted, error-free, or always-accurate service or answers.
• We are not liable for any indirect, consequential, or incidental damages, or for any loss arising from reliance on an AI-generated answer, any academic penalty, or any grade or exam outcome.
• Our total aggregate liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.
• Nothing in these Terms excludes liability that cannot be excluded under applicable law, or limits any non-waivable statutory consumer rights in your country of residence.

17. Indemnification

You agree to indemnify and hold harmless HouseofTech Innovation Pvt Ltd, its officers, employees, and partners from any claims arising from:

• Your or your child’s use or misuse of the Platform or its Content
• The questions, text, images, or voice input submitted through your account
• Your violation of these Terms
• Your infringement of any third-party right

18. Privacy Policy

Your use of Topper is also governed by our Privacy Policy, which explains how your child’s data, homework scans, device permissions, and parental consent are handled.

19. Modifications to Terms

• We may update these Terms at any time. Material changes will be communicated through the App.
• Continued use of the Platform after updates means you accept the revised Terms.

20. Governing Law & Jurisdiction

• These Terms are governed by the laws of India, without prejudice to any mandatory consumer-protection rules of the country where you habitually reside.
• Subject to such mandatory rules, disputes shall fall under the exclusive jurisdiction of courts in Gurgaon, Haryana, India.
