These Terms and Conditions (“Terms”) govern your access to and use of the Poster Magic application, website, software, and related services (collectively, the “Platform”), operated by HouseofTech Innovation Pvt Ltd (“we”, “us”, “our”, or the “Company”).

By accessing, downloading, registering, or using the Platform, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.

1. About the Platform

Poster Magic is a personalised poster and status app. It lets you browse a daily-updated library of posters, greetings, wishes, and flyers — such as Good Morning, festival, and devotional themes — add your name and photo, and share them as WhatsApp statuses or to other social platforms. Browsing the library and basic personalisation are free. Access to premium templates, advanced editing tools, and ad-free usage are part of Poster Magic Plus, a paid subscription with monthly and yearly options described in our Payment & Cancellation Policy.

2. A Design Tool, Not an Endorsement

• We do not verify the ownership, legality, or contents of any photo you upload or text you add to a poster.
• Poster Magic is not affiliated with, sponsored by, or endorsed by WhatsApp, Meta, or any other third-party social media platform to which you may share your creations.
• Features, templates, and limits may be updated, replaced, or removed at any time, and may vary by region, device, plan, build, and server load. Some features depend on your device’s capabilities and may not be available on every device or platform.

3. Photos, Camera & User-Generated Content

• Camera and gallery access are used only when you actively choose to add a photo to a template.
• Depending on the feature, image processing may happen locally on your device or securely on our servers.
• We do not use your uploaded photos for advertising, and we do not use them to train AI models.
• We are not liable for any action taken, or not taken, by third parties (including social media platforms) in response to content you generate and share.

4. Eligibility

• You must be at least 13 years old to use the App, and at least 18 years old (or the age of majority where you live) to purchase a subscription, or have the consent of a parent or guardian.
• By using the Platform you confirm you have the legal capacity — and, where you act for a business or employer, the authority — to accept these Terms.

5. Account Registration

• You can browse templates and create basic posters without an account. An account is required to subscribe, to save your designs to the cloud, and to access certain premium features.
• You register using your mobile number and a one-time password (OTP) sent to it. There is no separate password.
• You are responsible for keeping your mobile number and device secure and for all activity under your account. Tell us immediately if you lose control of the number or device linked to your account.
• You agree to provide accurate and complete information, and to use a mobile number you are entitled to use.
• We may suspend or terminate accounts with false, misleading, or shared credentials.

6. Your Content

• Photos you upload, and the posters, greetings, and flyers you generate (“Your Content”) remain yours. We claim no ownership over them.
• Your Content is stored on your device. It is transmitted to us only when you choose to save a design to your account or when server-side processing is required to render a high-quality poster.
• For those features only, you grant us a limited licence to host, store, process, and transmit Your Content solely to provide the requested feature to you.
• You confirm that you own Your Content or otherwise have the right to upload, edit, store, and share it, including where it contains another person’s image, personal data, or third-party intellectual property.
• You are responsible for keeping your own copies of posters you cannot afford to lose. Designs held only on your device and not saved to an account cannot be recovered by us if the device is lost, reset, or the App is uninstalled.

7. Our Content & Your Licence to Use the App

• All software, templates, layouts, branding, text, icons, fonts, and graphics forming part of the App (the “Content”) are owned by or licensed to HouseofTech Innovation Pvt Ltd and are protected by intellectual-property laws.
• We grant you a limited, non-exclusive, non-transferable, revocable licence to use the App and its templates to generate posters for your own personal or internal business purposes, while your account and (where applicable) subscription are active.
• Posters you produce are yours to share and use. However, you may not resell, redistribute, or sublicense the App itself, extract the raw templates or graphics to build a competing product, or share your subscription.
• The App includes open-source components, which remain governed by their own licences.

8. Acceptable Use & Restrictions

You agree not to:

• Use the App to create defamatory, offensive, explicit, or illegal posters, or to impersonate any person or organisation by using their photo or name without permission.
• Upload, edit, or distribute images you have no right to handle, or use the App to infringe copyright or other third-party rights.
• Use the App to generate deceptive content or spread misinformation.
• Resell, sublicense, or commercially redistribute the App, its raw templates, or your subscription, or provide access to third parties via automation or scraping.
• Reverse engineer or attempt to extract source code, proprietary designs, or template libraries.
• Circumvent usage limits, quotas, paywalls, or entitlement checks, or share a subscription across multiple people.
• Attempt to access another user’s account or saved designs.
• Upload malware, or files designed to disrupt, overload, or exploit the Platform or its infrastructure.
• Use the Platform for any unlawful, abusive, or harmful purpose.

9. Subscription, Pricing & Payments

• Poster Magic Plus is offered through paid subscription plans (currently monthly and yearly, with introductory or trial offers from time to time), and may include one-time in-app purchases.
• Current pricing and plan limits are displayed as shown at the paywall / in the App. Prices may vary by region and may change at any time; existing active subscriptions remain at the agreed price until renewal.
• Payments are processed by RBI-licensed payment gateway partners (such as Razorpay, PhonePe, or similar providers). The active payment gateway may change from time to time without prior notice. Billing is direct via these gateways, never Google Play Billing or Apple In-App Purchase.
• We do not store your full card or banking details on our servers.
• Subscriptions auto-renew until cancelled. See our Payment & Cancellation Policy for full details.
• Prices may be inclusive or exclusive of taxes (GST, VAT, sales tax) depending on your region; any applicable taxes are shown at checkout.

10. Usage Limits & Fair Use

• Free and paid plans carry limits — for example on the number of premium templates you can access, high-resolution exports, or cloud storage for saved designs. Current limits are shown in the App.
• We may set, adjust, or enforce these limits to keep the service reliable and affordable, and to prevent abuse. Material reductions affecting an active paid plan will be notified in advance.
• Automated, bulk, or commercial-scale generation beyond normal individual use may be throttled or suspended.

11. Refund & Cancellation

• There is NO in-app cancel button. Cancellation has exactly two routes:
  (A) in the user's UPI / bank app, find AutoPay and pause or cancel the mandate;
  (B) email the entity's support address.
• You may cancel auto-renewal at any time before the next billing cycle using one of the routes above. Cancellation prevents future charges; current period access continues until expiry.
• Completed payments are non-refundable except as described in our policy or where required by applicable consumer law (including any statutory withdrawal/cooling-off rights in your country).

12. Disclaimer

• The Platform is provided on an “as is” basis and is not guaranteed to produce posters that are accurate, culturally flawless, or suitable for any particular purpose.
• Image processing can alter layout, fonts, or file size, and output quality depends heavily on the quality of the photo you upload. Always check the output before sharing it.
• We do not guarantee that a poster or status created with the App will be accepted or displayed correctly by WhatsApp or any other third-party platform.

13. Service Availability & Data

• We aim for continuous availability but do not guarantee uninterrupted access. Maintenance, updates, or outages at our infrastructure may temporarily affect the service, including the daily updates to the template library.
• Cloud saving is a convenience feature, not a guaranteed archive. We take reasonable measures to protect stored designs, but you should keep your own copies of critical posters on your device.

14. Third-Party Services

• The Platform integrates third-party services such as Google Cloud (application hosting and object storage), SMS/OTP delivery providers, payment gateways (Razorpay, PhonePe), and analytics tools.
• You may also choose to share your creations to third-party platforms like WhatsApp.
• These services operate under their own terms and privacy policies. We are not responsible for their independent functionality or policies.

15. Suspension & Termination

We may suspend or terminate your account if:

• You violate these Terms, our usage rules, or applicable law.
• You use the App to create abusive, explicit, or unlawful content.
• Payments fail, are disputed, or charged back.
• You misuse the App in ways that harm other users or the Platform.
• Required by court order or government authority.

Where lawful and practical, we will give you a reasonable opportunity to export your saved designs before termination takes effect. Posters stored locally on your device are unaffected by account termination.

16. Limitation of Liability

To the maximum extent permitted by law:

• The Platform is provided on an “as is” and “as available” basis.
• We do not guarantee uninterrupted, error-free, or always-accurate service.
• We are not liable for any indirect, consequential, or incidental damages, or for loss of profit, revenue, business, goodwill, or data — including loss of saved posters, or any account suspension on third-party platforms resulting from content you share.
• Our total aggregate liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.
• Nothing in these Terms excludes liability that cannot be excluded under applicable law, or limits any non-waivable statutory consumer rights in your country of residence.

17. Indemnification

You agree to indemnify and hold harmless HouseofTech Innovation Pvt Ltd, its officers, employees, and partners from any claims arising from:

• Your use or misuse of the Platform
• Photos you upload, posters you generate, and their contents
• Your handling of any third party’s personal data, image, or intellectual property
• Your violation of these Terms
• Your infringement of any third-party right

18. Privacy Policy

Your use of Poster Magic is also governed by our Privacy Policy, which explains how your data and photos are handled.

19. Modifications to Terms

• We may update these Terms at any time. Material changes will be communicated through the App.
• Continued use of the Platform after updates means you accept the revised Terms.

20. Governing Law & Jurisdiction

• These Terms are governed by the laws of India, without prejudice to any mandatory consumer-protection rules of the country where you habitually reside.
• Subject to such mandatory rules, disputes shall fall under the exclusive jurisdiction of courts in Gurgaon, Haryana, India.
