These Terms and Conditions (“Terms”) govern your access to and use of the Pixy mobile application, website, software, and related services (collectively, the “Platform”), operated by HouseofTech Innovation Pvt Ltd (“we”, “us”, “our”, or the “Company”).

By accessing, downloading, registering, or using the Platform, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.

1. About the Platform

Pixy is a personalised poster and status app. It offers a daily-updated library of posters, greetings, wishes, and flyers — Good Morning, festival, devotional, motivational, business, and occasion designs — which you can personalise with your name, photo, business details, and WhatsApp number, then save and share on WhatsApp and other social apps. Some content is free; premium designs and features (such as watermark-free downloads and exclusive collections) require a paid subscription or in-app purchase.

2. The Content & Its Nature

• Templates, artwork, greetings, and festival designs are provided for you to personalise and share.
• Festival dates, greetings, quotes, and devotional references may vary across regions and traditions; content is provided for general reference and is not an authoritative ruling.
• Content libraries are updated daily and designs may be added, replaced, or removed at any time.
• Feature availability, content libraries, and quality may vary by region, device, plan, language, and server load.

3. Eligibility

• You must be at least 13 years old (or the higher minimum age required in your country, e.g. 16 in parts of the EEA) to use the App, and at least 18 (or the age of majority where you live) to purchase a subscription.
• By using the Platform, you confirm that you have the legal capacity to accept these Terms.

4. Account Registration

• You may browse parts of the App without an account; to personalise, save, or subscribe you sign in with your phone number and a one-time password (OTP).
• You are responsible for the security of your account and phone number, and for all activity under your account.
• You agree to provide accurate and complete information in your profile.
• We may suspend or terminate accounts with false, misleading, or shared credentials.

5. Device Permissions

• To add your photo or logo to a poster and to save finished posters, the App may request permissions such as photo/media selection, storage access, and notifications.
• These permissions are used only to deliver the features you request. You may revoke them from your device settings, though some features will then be unavailable.

6. Content Ownership & Your Use

• All templates, artwork, illustrations, fonts, layouts, images, text, graphics, branding, and other materials made available in the App (the “Content”) are owned by or licensed to HouseofTech Innovation Pvt Ltd or their respective rights holders, and are protected by intellectual-property laws.
• We grant you a limited, non-exclusive, non-transferable, revocable license to personalise, download, and share the Content for your own personal use and for promoting your own business, while your account and (where applicable) subscription are active.
• You may not resell the Content as templates, redistribute the template library, sublicense it, or offer a competing poster/design service using our Content, without our written permission.

7. Your Content & Responsibility

• You retain ownership of the photos, logos, names, and business details you upload (“Your Content”). You grant us a limited licence to process Your Content solely to render and deliver your personalised posters.
• You confirm that you have the right to use Your Content, including any photo of another person, any logo, and any trademark you add.
• You are solely responsible for the posters you create and share, and for any claim arising from them.
• We do not use Your Content for advertising, do not sell it, and do not use it to train models.

8. Acceptable Use & Restrictions

You agree not to:

• Create or share posters that are unlawful, defamatory, obscene, hateful, harassing, or that promote hatred against any community, faith, caste, or belief.
• Upload photos of other people without their consent, or impersonate any person, business, or organisation.
• Use the Platform to create misleading political, medical, financial, or promotional claims.
• Resell, sublicense, or commercially redistribute the App, the template library, or your subscription, or provide access to third parties via automation/scraping.
• Reverse engineer or attempt to extract source code, models, or proprietary systems.
• Circumvent usage limits, paywalls, watermarks, geo-restrictions, or content protections.
• Share your account or active subscription with others.

We may remove content and suspend accounts that breach these rules.

9. Subscription, Pricing & Payments

• Premium designs and features are available through paid subscription plans and/or one-time in-app purchases.
• Current pricing is displayed inside the App at the time of purchase, in your local currency where supported. Prices may vary by region and may change at any time; existing active subscriptions remain at the agreed price until renewal.
• Payments are processed by RBI-licensed payment gateway partners (such as Razorpay, PhonePe, or similar providers), supporting UPI & UPI Autopay, credit/debit cards, and netbanking. The active payment gateway may change from time to time without prior notice.
• Billing is handled directly by the payment gateway and not through Google Play or Apple in-app billing.
• We do not store your full card or banking details on our servers.

• Prices may be exclusive of taxes (VAT, GST, sales tax) depending on your region; any applicable taxes are shown at checkout.

10. Refund & Cancellation

• You may cancel auto-renewal at any time before the next billing cycle. Cancellation prevents future charges; current period access continues until expiry.
• Completed payments are non-refundable except as described in our policy or where required by applicable consumer law (including any statutory withdrawal/cooling-off rights in your country).

11. Disclaimer

• Pixy provides design templates and creative content. Content is provided on an “as is” basis and is not guaranteed to be accurate, complete, or authoritative for any festival, tradition, or occasion.
• We do not guarantee any specific reach, engagement, business, or other outcome from posters you share.
• You are solely responsible for how you use and share the Content, including compliance with the laws and customs of your jurisdiction and the rules of any platform you share to.

12. Intellectual Property & Third-Party Rights

• All software, design, branding, and Content on the Platform are owned by or licensed to HouseofTech Innovation Pvt Ltd or their respective rights holders.
• You receive a personal/business-use license only; no ownership of the Platform or Content transfers to you.
• If you are a rights holder and believe content infringes your rights, contact us at the email below and we will review and, where appropriate, remove it.

13. Third-Party Services

• The Platform integrates third-party services such as payment gateways (Razorpay, PhonePe), SMS/OTP providers, cloud storage and content-delivery networks, and analytics tools.
• These services operate under their own terms and privacy policies. We are not responsible for their independent functionality or policies.

14. Suspension & Termination

We may suspend or terminate your account if:

• You violate these Terms, our usage rules, or applicable law.
• Payments fail, are disputed, or charged back.
• You misuse the App in ways that harm other users, third parties, or the Platform.
• Required by court order or government authority.

15. Limitation of Liability

To the maximum extent permitted by law:

• The Platform is provided on an “as is” and “as available” basis.
• We do not guarantee uninterrupted, error-free, or always-accurate service or content.
• We are not liable for any indirect, consequential, or incidental damages, or for any loss arising from posters you create or share.
• Our total aggregate liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.
• Nothing in these Terms excludes liability that cannot be excluded under applicable law, or limits any non-waivable statutory consumer rights in your country of residence.

16. Indemnification

You agree to indemnify and hold harmless HouseofTech Innovation Pvt Ltd, its officers, employees, and partners from any claims arising from:

• Your use or misuse of the Platform or its Content
• Posters you create, share, or publish, and the photos and details you add to them
• Your violation of these Terms
• Your infringement of any third-party right

17. Privacy Policy

Your use of Pixy is also governed by our Privacy Policy, which explains how your personal data, photos, and device permissions are handled.

18. Modifications to Terms

• We may update these Terms at any time. Material changes will be communicated through the App.
• Continued use of the Platform after updates means you accept the revised Terms.

19. Governing Law & Jurisdiction

• These Terms are governed by the laws of India, without prejudice to any mandatory consumer-protection rules of the country where you habitually reside.
• Subject to such mandatory rules, disputes shall fall under the exclusive jurisdiction of courts in Gurgaon, Haryana, India.
