These Terms and Conditions (“Terms”) govern your access to and use of the Photo POP application, website, software, and related services (collectively, the “Platform”), operated by HouseofTech Innovation Pvt Ltd (“we”, “us”, “our”, or the “Company”).

By accessing, downloading, registering, or using the Platform, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.

1. About the Platform

Photo POP is a personalised poster and status app. It lets you browse a daily-updated library of posters, greetings, wishes, and flyers — including Good Morning, festival, and devotional themes — add your name and photo, and share them directly as WhatsApp statuses or to other platforms. Browsing the basic library and creating standard greetings are free. Access to premium templates, high-resolution exports, and ad-free usage are part of Photo POP Plus, a paid subscription with monthly and yearly plan options described in our Payment & Cancellation Policy.

2. Content & Sharing Disclaimer

• We do not monitor or verify the photos, names, or custom text you add to our templates before you share them.
• Templates, greetings, and festival flyers may be updated, replaced, or removed at any time to keep the library fresh. We do not guarantee that a specific festival or greeting will have a template available on a given day.
• Photo POP is not a substitute for professional graphic design services.
• Features, tools, and limits may vary by region, device, plan, build, and server load. Some features depend on your device’s capabilities and may not be available on every device or platform.

3. User-Generated Content & Photos

• Photos you upload are processed to fit into the selected poster or flyer template. This requires access to your device’s camera or photo gallery, which you must permit in your device settings.
• We do not claim ownership of your personal photos, but you grant us a temporary licence to process them to generate your final poster.
• We are not liable for any disputes arising from the images you choose to upload or the final posters you share publicly or privately.

4. Eligibility

• You must be at least 13 years old to use the App, and at least 18 years old (or the age of majority where you live) to purchase a subscription, or have the consent of a parent or guardian.
• By using the Platform you confirm you have the legal capacity — and, where you act for a business or employer, the authority — to accept these Terms.

5. Account Registration

• You can browse the library without an account. An account is required to subscribe to Photo POP Plus and to save your favourite templates.
• You register using your mobile number and a one-time password (OTP) sent to it. There is no separate password.
• You are responsible for keeping your mobile number and device secure and for all activity under your account. Tell us immediately if you lose control of the number or device linked to your account.
• You agree to provide accurate and complete information, and to use a mobile number you are entitled to use.
• We may suspend or terminate accounts with false, misleading, or shared credentials.

6. Your Content

• Photos you upload, names you enter, and the final personalised posters you create (“Your Content”) remain yours. We claim no ownership over them.
• Your Content is processed on your device or temporarily on our servers to generate the final image. We do not use your personal photos for advertising.
• You confirm that you own Your Content or otherwise have the right to upload, edit, and share it, including where it contains another person’s likeness or third-party intellectual property.
• You are responsible for saving your generated posters to your device gallery. We do not permanently store your generated statuses, and they cannot be recovered by us if your device is lost or the App is uninstalled.

7. Our Content & Your Licence to Use the App

• All software, templates, background designs, festival flyers, greetings, text, icons, and graphics forming part of the App (the “Content”) are owned by or licensed to HouseofTech Innovation Pvt Ltd and are protected by intellectual-property laws.
• We grant you a limited, non-exclusive, non-transferable, revocable licence to use the App for your own personal or internal business purposes, while your account and (where applicable) subscription are active.
• Posters you produce are yours to use and share. You may not resell, redistribute, or sublicense the App itself or your subscription, extract our raw templates to build a competing product, or use our templates for large-scale commercial advertising without permission.
• The App includes open-source components, which remain governed by their own licences.

8. Acceptable Use & Restrictions

You agree not to:

• Use the App to create deceptive, defamatory, obscene, or harmful posters and statuses.
• Upload photos, logos, or artwork you have no right to use, infringing copyright or trademark rights.
• Impersonate any person, brand, or organisation in your generated flyers.
• Resell, sublicense, or commercially redistribute the App, your subscription, or our raw template library, or provide access to third parties via automation or scraping.
• Reverse engineer or attempt to extract source code or proprietary template files.
• Circumvent usage limits, quotas, paywalls, or entitlement checks, or share a subscription across multiple people.
• Attempt to access another user’s account or saved templates.
• Upload malware, or files designed to disrupt, overload, or exploit the Platform or its infrastructure.
• Use the Platform for any unlawful, abusive, or harmful purpose.

9. Subscription, Pricing & Payments

• Photo POP Plus is offered through paid subscription plans (currently monthly and yearly, with introductory or trial offers from time to time), and may include one-time in-app purchases.
• Current pricing and plan limits are displayed as shown at the paywall / in the App. Prices may vary by region and may change at any time; existing active subscriptions remain at the agreed price until renewal.
• Payments are processed by RBI-licensed payment gateway partners (such as Razorpay, PhonePe, or similar providers). The active payment gateway may change from time to time without prior notice.
• We do not store your full card or banking details on our servers.
• Subscriptions auto-renew until cancelled. See our Payment & Cancellation Policy for full details.
• Prices may be inclusive or exclusive of taxes (GST, VAT, sales tax) depending on your region; any applicable taxes are shown at checkout.

10. Usage Limits & Fair Use

• Free and paid plans carry limits — for example on the number of premium templates you can access, daily high-resolution exports, or image processing requests. Current limits are shown in the App.
• We may set, adjust, or enforce these limits to keep the service reliable and affordable, and to prevent abuse. Material reductions affecting an active paid plan will be notified in advance.
• Automated, bulk, or commercial-scale poster generation beyond normal individual use may be throttled or suspended.

11. Refund & Cancellation

• There is NO in-app cancel button. To cancel your subscription auto-renewal, you must use one of two routes: (A) in your UPI / bank app, find AutoPay and pause or cancel the mandate; or (B) email our support address at support@houseoftech.ai. Cancellation prevents future charges; current period access continues until expiry.
• Completed payments are non-refundable except as described in our policy or where required by applicable consumer law (including any statutory withdrawal/cooling-off rights in your country).

12. Disclaimer

• The Platform is provided on an “as is” basis and is not guaranteed to produce posters that are perfectly formatted for every device screen or social media platform.
• Image processing can alter colours, resolution, or cropping. Always check the output before sharing it to WhatsApp or elsewhere.
• We are not liable for loss of quality or formatting in files you generate.

13. Service Availability & Data

• We aim for continuous availability but do not guarantee uninterrupted access. Maintenance, updates, or outages at our infrastructure providers may temporarily affect the service.
• The daily-updated library requires an active internet connection to fetch new posters and greetings.
• We do not permanently back up your generated posters. You should save important flyers to your device’s camera roll or gallery.

14. Third-Party Services

• The Platform integrates third-party services such as Google Cloud (application hosting and object storage), SMS/OTP delivery providers, payment gateways (Razorpay, PhonePe), and analytics tools.
• These services operate under their own terms and privacy policies. We are not responsible for their independent functionality or policies.

15. Suspension & Termination

We may suspend or terminate your account if:

• You violate these Terms, our usage rules, or applicable law.
• You use the App to generate unlawful, defamatory, or offensive content.
• Payments fail, are disputed, or charged back.
• You misuse the App in ways that harm other users or the Platform.
• Required by court order or government authority.

Posters saved locally to your device gallery are unaffected by account termination.

16. Limitation of Liability

To the maximum extent permitted by law:

• The Platform is provided on an “as is” and “as available” basis.
• We do not guarantee uninterrupted, error-free, or always-accurate service.
• We are not liable for any indirect, consequential, or incidental damages, or for loss of profit, revenue, business, goodwill, or data — including loss or corruption of photos, rejection of a shared status, or any dispute arising from content you share.
• Our total aggregate liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.
• Nothing in these Terms excludes liability that cannot be excluded under applicable law, or limits any non-waivable statutory consumer rights in your country of residence.

17. Indemnification

You agree to indemnify and hold harmless HouseofTech Innovation Pvt Ltd, its officers, employees, and partners from any claims arising from:

• Your use or misuse of the Platform
• Photos you upload, names you enter, and the final posters you share
• Your handling of any third party’s personal data or intellectual property
• Your violation of these Terms
• Your infringement of any third-party right

18. Privacy Policy

Your use of Photo POP is also governed by our Privacy Policy, which explains how your data and photos are handled.

19. Modifications to Terms

• We may update these Terms at any time. Material changes will be communicated through the App.
• Continued use of the Platform after updates means you accept the revised Terms.

20. Governing Law & Jurisdiction

• These Terms are governed by the laws of India, without prejudice to any mandatory consumer-protection rules of the country where you habitually reside.
• Subject to such mandatory rules, disputes shall fall under the exclusive jurisdiction of courts in Gurgaon, Haryana, India.
