These Terms and Conditions (“Terms”) govern your access to and use of the Fable mobile application, website, software, and related services (collectively, the “Platform”), operated by HouseofTech Innovation Pvt Ltd (“we”, “us”, “our”, or the “Company”).

By accessing, downloading, registering, or using the Platform, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.

1. About the Platform

Fable is a short-video story app for children that delivers bite-sized, kid-friendly story videos organised into playlists, collections, and themes, with viewing progress and age-appropriate recommendations. Some features are free; premium features require a paid subscription managed by the parent/guardian.

2. Content & Its Nature

• Content is created for a young audience and produced in a short-video story format; themes, style, and depth may vary.
• Content libraries may be updated, replaced, or removed at any time.
• Some content may be produced or reviewed with the help of automated tools; we make reasonable efforts toward quality and age-appropriateness but do not warrant that all content is free of error.
• Feature availability, content libraries, playback quality, and recommendations may vary by region, device, plan, language, and server load.

3. Eligibility & Parental Responsibility

• The App is intended for children to use under the supervision of a parent or legal guardian.
• You must be at least 18 years old (or the age of majority where you live) to create an account, accept these Terms, and purchase a subscription.
• By using the Platform, you confirm that you are a parent or legal guardian with the legal capacity to accept these Terms on behalf of the child, and that you consent to the child’s use of the App.

4. Account Registration

• The parent/guardian may sign up using an email address or a supported identity provider (Google, Apple).
• You are responsible for the security of your account credentials and for all activity under your account, including your child’s use of the App.
• You agree to provide accurate and complete information.
• We may suspend or terminate accounts with false, misleading, or shared credentials.

5. Content Ownership & Your Use

• All story videos, audio, text, illustrations, characters, branding, and other materials made available in the App (the “Content”) are owned by or licensed to HouseofTech Innovation Pvt Ltd and are protected by intellectual-property laws.
• We grant you a limited, non-exclusive, non-transferable, revocable license to stream and view the Content for your family’s personal, non-commercial use, while your account and (where applicable) subscription are active.
• You may not download (except where the App provides an explicit offline feature), copy, record, screen-capture, redistribute, publicly perform, resell, or create derivative works from the Content without our written permission.

6. Acceptable Use & Restrictions

You agree not to:

• Resell, sublicense, or commercially redistribute the App, the Content, or your subscription, or provide access to third parties via automation/scraping.
• Reverse engineer or attempt to extract source code, models, or proprietary systems.
• Circumvent usage limits, paywalls, geo-restrictions, or content protections (DRM).
• Use the Platform for any unlawful, fraudulent, abusive, or harmful purpose.
• Share your account or active subscription with others outside your household.

7. Subscription, Pricing & Payments

• Premium features are available through paid subscription plans managed by the parent/guardian.
• Current pricing is displayed inside the App at the time of purchase, in your local currency where supported. Prices may vary by region and may change at any time; existing active subscriptions remain at the agreed price until renewal.
• Payments are processed by Google Play Billing (Android), Apple In-App Purchase / Apple Pay (iOS), or licensed payment processors such as Razorpay (web and supported regions), supporting credit/debit cards and local payment methods. The active processor may change without prior notice.
• We do not store your full card or banking details on our servers.
• Subscriptions auto-renew until cancelled. Purchases made through Google Play or the Apple App Store are also subject to Google’s and Apple’s own terms and refund policies. See our Payment & Cancellation Policy for full details.
• Prices may be exclusive of taxes (VAT, GST, sales tax) depending on your region; any applicable taxes are shown at checkout or applied by the app store.

8. Refund & Cancellation

• You may cancel auto-renewal at any time before the next billing cycle. Cancellation prevents future charges; current period access continues until expiry.
• Purchases via Google Play or the Apple App Store follow the refund policies of those stores. For direct purchases (e.g., via Razorpay), completed payments are non-refundable except as described in our policy or where required by applicable consumer law (including any statutory withdrawal/cooling-off rights in your country).

9. Disclaimer

• Fable is an entertainment and storytelling app for children. Content is provided for general enjoyment and is not guaranteed to be accurate, complete, current, or fit for any particular purpose.
• We do not guarantee any specific educational or developmental outcome, result, or benefit.
• Parents and guardians are solely responsible for supervising their child’s use of the App and deciding what content is suitable.

10. Intellectual Property Rights

• All software, design, branding, characters, and Content on the Platform are owned by or licensed to HouseofTech Innovation Pvt Ltd.
• You receive a personal-use license only; no ownership of the Platform or Content transfers to you.
• Unauthorised commercial reproduction, redistribution, or modification may result in legal action.

11. Third-Party Services

• The Platform integrates third-party services such as payment processors (Google Play Billing, Apple In-App Purchase, Razorpay), sign-in providers (Google, Apple), cloud storage and content-delivery networks, and child-appropriate analytics tools.
• These services operate under their own terms and privacy policies. We are not responsible for their independent functionality or policies.

12. Suspension & Termination

We may suspend or terminate your account if:

• You violate these Terms, our usage rules, or applicable law.
• Payments fail, are disputed, or charged back.
• You misuse the App in ways that harm other users or the Platform.
• Required by court order or government authority.

13. Limitation of Liability

To the maximum extent permitted by law:

• The Platform is provided on an “as is” and “as available” basis.
• We do not guarantee uninterrupted, error-free, or always-accurate service or content.
• We are not liable for any indirect, consequential, or incidental damages, or for any loss arising from reliance on the Content.
• Our total aggregate liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.
• Nothing in these Terms excludes liability that cannot be excluded under applicable law, or limits any non-waivable statutory consumer rights in your country of residence.

14. Indemnification

You agree to indemnify and hold harmless HouseofTech Innovation Pvt Ltd, its officers, employees, and partners from any claims arising from:

• Your use or misuse of the Platform or its Content
• Your violation of these Terms
• Your infringement of any third-party right

15. Privacy Policy

Your use of Fable is also governed by our Privacy Policy, which explains how personal and viewing data are handled, including our approach to children’s privacy.

16. Modifications to Terms

• We may update these Terms at any time. Material changes will be communicated through the App.
• Continued use of the Platform after updates means you accept the revised Terms.

17. Governing Law & Jurisdiction

• These Terms are governed by the laws of India, without prejudice to any mandatory consumer-protection rules of the country where you habitually reside.
• Subject to such mandatory rules, disputes shall fall under the exclusive jurisdiction of courts in Gurgaon, Haryana, India.
