These Terms and Conditions (“Terms”) govern your access to and use of the Vaazhga Tamil mobile application, website, software, and related services (collectively, the “Platform”), operated by HouseofTech Innovation Pvt Ltd (“we”, “us”, “our”, or the “Company”).

By accessing, downloading, registering, or using the Platform, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.

1. About the Platform

Vaazhga Tamil is a Tamil poster-maker app that offers a library of ready-made posters, greetings, wallpapers, and images — for festivals, good-morning and good-night wishes, cultural and community occasions, leaders, and special days — which you can personalise with your name and photo, then download and share. Some content is free; premium content and features require a paid subscription or in-app purchase.

2. Content & Its Nature

• Posters, wallpapers, and images are provided for personal, non-commercial use — to greet, celebrate, and share on social media and messaging apps.
• Templates, categories, and content libraries may be updated, replaced, or removed at any time.
• Feature availability, content libraries, and quality may vary by region, device, plan, language, and server load.

3. Eligibility

• You must be at least 13 years old (or the higher minimum age required in your country, e.g. 16 in parts of the EEA) to use the App, and at least 18 (or the age of majority where you live) to purchase a subscription.
• By using the Platform, you confirm that you have the legal capacity to accept these Terms.

4. Account Registration

• You may use parts of the App without an account; to save favourites or subscribe you may sign up using your mobile number (OTP), email address, or a supported identity provider (Google, Apple).
• You are responsible for the security of your account credentials and for all activity under your account.
• You agree to provide accurate and complete information.
• We may suspend or terminate accounts with false, misleading, or shared credentials.

5. Device Permissions

• To personalise, save, and share posters, the App may request permissions such as photos/media access (to pick a photo and save finished posters), the camera (optional, only if you choose to take a new photo), and storage.
• These permissions are used only to deliver the features you request. You may revoke them from your device settings, though some features (such as adding your photo) will then be unavailable.

6. Your Content & Your Photo

• You retain ownership of the name, text, and photo you add to a poster (“Your Content”). You grant us a limited licence to process Your Content only to render, save, and deliver the personalised poster you requested.
• You confirm that you have the right to use any photo or text you add, and that it does not infringe anyone’s rights or violate any law. You are solely responsible for what you add and how you share the finished poster.
• You must not use the App to create posters that are unlawful, defamatory, obscene, hateful, or that impersonate or misuse the image of another person without consent.

7. Content Ownership & Your Use

• All templates, backgrounds, artwork, images, text, graphics, branding, and other materials made available in the App (the “Content”) are owned by or licensed to HouseofTech Innovation Pvt Ltd or their respective rights holders, and are protected by intellectual-property laws.
• We grant you a limited, non-exclusive, non-transferable, revocable license to use the Content to create posters for your own personal, non-commercial use, while your account and (where applicable) subscription are active.
• You may not resell, redistribute, sublicense, or create derivative works from the Content itself (as distinct from the personalised poster you generate for personal use), or use it for commercial purposes, without our written permission.

8. Acceptable Use & Restrictions

You agree not to:

• Resell, sublicense, or commercially redistribute the App, the Content, or your subscription, or provide access to third parties via automation/scraping.
• Reverse engineer or attempt to extract source code, models, or proprietary systems.
• Circumvent usage limits, paywalls, watermarks, geo-restrictions, or content protections.
• Use the Platform for any unlawful, fraudulent, abusive, or harmful purpose, or to create content that promotes hatred against any community, faith, or belief, or that defames or harasses any person.
• Share your account or active subscription with others.

9. Subscription, Pricing & Payments

• Premium content and features are available through paid subscription plans and/or one-time in-app purchases.
• Current pricing is displayed inside the App at the time of purchase, in your local currency where supported. Prices may vary by region and may change at any time; existing active subscriptions remain at the agreed price until renewal.
• Payments are processed by RBI-licensed payment gateway partners (such as Razorpay, PhonePe, or similar providers), supporting UPI & UPI Autopay, credit/debit cards, and netbanking. The active payment gateway may change from time to time without prior notice.
• We do not store your full card or banking details on our servers.
• Subscriptions auto-renew until cancelled. See our Payment & Cancellation Policy for full details.
• Prices may be exclusive of taxes (VAT, GST, sales tax) depending on your region; any applicable taxes are shown at checkout.

10. Refund & Cancellation

• You may cancel auto-renewal at any time before the next billing cycle. Cancellation prevents future charges; current period access continues until expiry.
• Completed payments are non-refundable except as described in our policy or where required by applicable consumer law (including any statutory withdrawal/cooling-off rights in your country).

11. Disclaimer

• Vaazhga Tamil provides poster and greeting content for personal use. Content is provided on an “as is” basis and is not guaranteed to be accurate, complete, or suitable for any particular purpose.
• You are solely responsible for how you use and share the posters you create, including compliance with the laws and customs of your jurisdiction and respect for the rights of others.

12. Intellectual Property & Third-Party Rights

• All software, design, branding, and Content on the Platform are owned by or licensed to HouseofTech Innovation Pvt Ltd or their respective rights holders.
• You receive a personal-use license only; no ownership of the Platform or Content transfers to you.
• If you are a rights holder and believe content infringes your rights, contact us at the email below and we will review and, where appropriate, remove it.

13. Third-Party Services

• The Platform integrates third-party services such as payment gateways (Razorpay, PhonePe), sign-in and OTP providers (Google, Apple, SMS gateways), cloud storage, image-rendering infrastructure, content-delivery networks, and analytics tools.
• These services operate under their own terms and privacy policies. We are not responsible for their independent functionality or policies.

14. Suspension & Termination

We may suspend or terminate your account if:

• You violate these Terms, our usage rules, or applicable law.
• Payments fail, are disputed, or charged back.
• You misuse the App in ways that harm other users, third parties, or the Platform.
• Required by court order or government authority.

15. Limitation of Liability

To the maximum extent permitted by law:

• The Platform is provided on an “as is” and “as available” basis.
• We do not guarantee uninterrupted, error-free, or always-accurate service or content.
• We are not liable for any indirect, consequential, or incidental damages, or for any loss arising from your use of the Content or the posters you create and share.
• Our total aggregate liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.
• Nothing in these Terms excludes liability that cannot be excluded under applicable law, or limits any non-waivable statutory consumer rights in your country of residence.

16. Indemnification

You agree to indemnify and hold harmless HouseofTech Innovation Pvt Ltd, its officers, employees, and partners from any claims arising from:

• Your use or misuse of the Platform or its Content
• The name, text, or photo you add to posters and how you share them
• Your violation of these Terms
• Your infringement of any third-party right

17. Privacy Policy

Your use of Vaazhga Tamil is also governed by our Privacy Policy, which explains how your personal data, photos, and device permissions are handled.

18. Modifications to Terms

• We may update these Terms at any time. Material changes will be communicated through the App.
• Continued use of the Platform after updates means you accept the revised Terms.

19. Governing Law & Jurisdiction

• These Terms are governed by the laws of India, without prejudice to any mandatory consumer-protection rules of the country where you habitually reside.
• Subject to such mandatory rules, disputes shall fall under the exclusive jurisdiction of courts in Gurgaon, Haryana, India.
