These Terms and Conditions (“Terms”) govern your access to and use of the Saarthi mobile application, website, software, AI mentor, and related services (collectively, the “Platform”), operated by HouseofTech Innovation Pvt Ltd (“we”, “us”, “our”, or the “Company”).

By accessing, downloading, registering, or using the Platform, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.

1. About the Platform

Saarthi is a UPSC preparation platform with an AI mentor. It offers personalised study planning, syllabus coverage, current-affairs digests, practice questions and mock tests, AI-assisted answer-writing feedback, and subject doubt resolution. Content is curated, licensed, or created by the Company; certain content and features are available only to paid subscribers.

2. Eligibility

• You must be at least 13 years old to use the Platform.
• If you are under 18, you must use the Platform under parental or guardian supervision.
• By using the Platform, you confirm that you have the legal capacity to accept these Terms.

3. Account Registration

• Account creation is required for most features and is performed via OTP-based mobile or email verification.
• You are responsible for the security of your registered phone number, email, and OTP.
• You agree to provide accurate and complete information.
• We may suspend or terminate accounts with false, misleading, or shared credentials.

4. License & Usage Rights

4.1 License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform’s study material, AI mentor outputs, mock tests, and other content for your personal, non-commercial UPSC preparation only.

4.2 Restrictions

You agree not to:

• Resell, sublicense, redistribute, upload, or commercially exploit any study material, notes, mock tests, AI-generated answers, or other content obtained from the Platform.
• Re-publish Platform content on YouTube, Telegram, websites, file-sharing services, third-party coaching products, or any other channel.
• Modify, edit, or remove watermarks, branding, or copyright notices from any Platform content.
• Use Platform content or AI outputs to defame, demean, or incite hatred against any community, religion, caste, region, or individual.
• Use Platform content in any commercial product, coaching service, broadcast, film, game, or paid service.
• Reverse engineer, scrape, bulk-download, or attempt to extract source code, content databases, prompts, or APIs.
• Misuse the AI mentor for generating disallowed content (hate speech, plagiarism for credentialing exams, exam impersonation, malware, etc.).
• Use the Platform for unlawful, abusive, or harmful purposes.
• Share your account, OTP, or active subscription with others.

5. Subscription, Pricing & Payments

• Premium content and features are available through paid subscription plans.
• Current pricing is displayed inside the App / website and on the paywall screen at the time of purchase.
• Prices are in INR and inclusive of applicable taxes unless stated otherwise. Prices may change at any time without prior notice; existing active subscriptions remain at the price agreed at purchase until renewal.
• Payments are processed securely via RBI-licensed payment gateway partners (such as Razorpay, PhonePe, or similar providers) supporting UPI, cards, netbanking, and UPI Autopay. The active payment gateway may change from time to time without prior notice.
• We do not store your full card or banking details on our servers.
• Subscriptions auto-renew via UPI Autopay or card mandate until cancelled. See our Payment & Cancellation Policy for full details.

6. Refund & Cancellation

• You may cancel auto-renewal at any time before the next billing cycle. Cancellation prevents future charges; current period access continues until expiry.
• Due to the digital nature of the content, all completed payments are non-refundable except where required by applicable law.

7. AI Mentor & Content Disclaimer

• The Saarthi AI mentor is a study aid powered by large language models. Its responses may contain inaccuracies, outdated facts, or omissions. You are responsible for cross-checking critical information against authoritative sources (NCERTs, government publications, standard reference books, and the official UPSC syllabus).
• Saarthi does not guarantee selection, qualification, rank, or any specific outcome in the UPSC Civil Services Examination or any other competitive examination. Outcomes depend on individual effort, exam conditions, and the Commission’s independent evaluation.
• Mock-test scores, AI evaluation scores, predicted ranks, and analytics are estimates intended for self-assessment, not formal predictions.
• Current-affairs digests, syllabus mapping, and reference summaries are provided in good faith; we do not guarantee that every entry is exhaustive or error-free.
• Saarthi is not affiliated with the Union Public Service Commission (UPSC), the Government of India, or any official examination body.

8. User Conduct

• You are responsible for the lawful and respectful use of the Platform and any content accessed through it.
• Do not use the Platform to harass, threaten, or incite violence against any individual, community, or religion.
• Do not use AI-generated content from the Platform to engage in academic dishonesty, exam fraud, or impersonation.
• Misuse may result in suspension or termination of your account and reporting to authorities where applicable.

9. Intellectual Property Rights

• All study material, notes, questions, mock tests, designs, branding, software, prompts, and underlying systems on the Platform are owned by, licensed to, or licensed by HouseofTech Innovation Pvt Ltd from rights holders.
• You receive a personal-use license only; no ownership transfers to you.
• Unauthorised commercial reproduction, redistribution, or modification may result in legal action under the Copyright Act, 1957 and related laws.

10. Third-Party Services

• The Platform integrates third-party services such as payment gateway partners (e.g., Razorpay, PhonePe), voicensms.in (OTP delivery), AI model providers (for the mentor and evaluation features), cloud storage and content-delivery providers, and analytics tools.
• These services operate under their own terms and privacy policies. We are not responsible for their independent functionality or policies.

11. Suspension & Termination

We may suspend or terminate your account if:

• You violate these Terms or applicable law.
• Payments fail, are disputed, or chargedback.
• You misuse content or the AI mentor in ways that harm rights holders, other users, or the Platform.
• Required by court order or government authority.

12. Limitation of Liability

To the maximum extent permitted by law:

• The Platform is provided on an “as is” and “as available” basis.
• We do not guarantee uninterrupted or error-free service.
• We are not liable for any indirect, consequential, or incidental damages, for decisions taken on the basis of AI-generated content, or for misuse of downloaded content by users or third parties.

13. Indemnification

You agree to indemnify and hold harmless HouseofTech Innovation Pvt Ltd, its officers, employees, and partners from any claims arising from:

• Your use or misuse of the Platform or its content
• Your violation of these Terms
• Your infringement of any third-party right, including intellectual property and right of publicity

14. Privacy Policy

Your use of Saarthi is also governed by our Privacy Policy, which explains how your data is collected and used.

15. Modifications to Terms

• We may update these Terms at any time. Material changes will be communicated through the App or website.
• Continued use of the Platform after updates means you accept the revised Terms.

16. Governing Law & Jurisdiction

• These Terms are governed by the laws of India.
• Disputes shall fall under the exclusive jurisdiction of courts in Gurgaon, Haryana.
