These Terms and Conditions (“Terms”) govern your access to and use of the Rizzup mobile application, website, software, and related services (collectively, the “Platform”), operated by HouseofTech Innovation Pvt Ltd (“we”, “us”, “our”, or the “Company”).

By accessing, downloading, registering, or using the Platform, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.

1. About the Platform

Rizzup is a men’s self-improvement and personal-transformation app that helps users look more attractive and confident through AI-powered photo and facial analysis, personalised grooming, skincare, hairstyle and style guidance, jawline and posture routines, fitness tips, and before/after progress tracking. Content and recommendations are curated and updated by the Company; certain content and features are available only to paid subscribers.

2. Eligibility

• You must be at least 13 years old to use the Platform.
• If you are under 18, you must use the Platform under parental or guardian supervision.
• By using the Platform, you confirm that you have the legal capacity to accept these Terms.

3. Account Registration

• Account creation is required for most features and is performed via OTP-based mobile verification.
• You are responsible for the security of your registered phone number and OTP.
• You agree to provide accurate and complete information.
• We may suspend or terminate accounts with false, misleading, or shared credentials.

4. Photos You Upload

• You confirm that any photo you upload is of yourself, or that you have the explicit consent of the person shown, and that you have the right to submit it.
• You must not upload photos of minors, photos that are sexually explicit, nude, obscene, or that depict another identifiable person without their consent.
• You retain ownership of your photos. You grant us a limited licence to process them solely to provide the App’s analysis, recommendation, and progress features to you, as described in our Privacy Policy.
• We may remove content and suspend accounts that violate these rules.

5. License & Usage Rights

5.1 License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to access the Platform for personal, non-commercial use. Content, routines, recommendations, and analysis results are provided for your individual use and may not be redistributed.

5.2 Restrictions

You agree not to:

• Resell, sublicense, or commercially exploit any content or analysis output.
• Record, scrape, or rip content for redistribution.
• Modify, edit, or remove watermarks or branding from any Platform content.
• Use the Platform to defame, demean, harass, or incite hatred against any individual or group.
• Reverse engineer or attempt to extract source code, content databases, or analysis models.
• Use the Platform for unlawful, abusive, or harmful purposes.
• Share your account, OTP, or active subscription with others.
• Upload photos of other people without their consent, or any unlawful, explicit, or infringing imagery.

6. Nature of Ratings & Recommendations

• Attractiveness ratings, facial-analysis scores, and recommendations are generated by automated models and are provided for entertainment, motivation, and general self-improvement guidance only.
• They are subjective, approximate, and not a medical, dermatological, psychological, or professional assessment of any kind.
• The Platform does not provide medical, cosmetic, or mental-health advice. Consult a qualified professional before making decisions about your skin, health, fitness, or any cosmetic procedure.
• We do not guarantee any specific change in your appearance, attractiveness, confidence, dating, social, or career outcome from using the Platform.

7. Subscription, Pricing & Payments

• Premium content and features are available through paid subscription plans.
• Current pricing is displayed inside the App and on the paywall screen at the time of purchase.
• Prices are in INR and inclusive of applicable taxes unless stated otherwise. Prices may change at any time without prior notice; existing active subscriptions remain at the price agreed at purchase until renewal.
• Payments are processed securely via RBI-licensed payment gateway partners (such as Razorpay, PhonePe, or similar providers) supporting UPI, cards, netbanking, and UPI Autopay. The active payment gateway may change from time to time without prior notice.
• We do not store your full card or banking details on our servers.
• Subscriptions auto-renew via UPI Autopay or card mandate until cancelled. See our Payment & Cancellation Policy for full details.

8. Refund & Cancellation

• You may cancel auto-renewal at any time before the next billing cycle. Cancellation prevents future charges; current period access continues until expiry.
• Due to the digital nature of the content, all completed payments are non-refundable except where required by applicable law.

9. User Conduct

• You are responsible for the lawful and respectful use of the Platform and any content accessed through it.
• Do not use the Platform to harass, threaten, or incite violence against any individual or group.
• Misuse may result in suspension or termination of your account and reporting to authorities where applicable.

10. Intellectual Property Rights

• All content, routines, artwork, designs, branding, and software on the Platform are owned by or licensed to HouseofTech Innovation Pvt Ltd.
• You receive a personal-use license only; no ownership transfers to you.
• Unauthorised commercial reproduction, redistribution, or modification may result in legal action.

11. Third-Party Services

• The Platform integrates third-party services such as payment gateway partners (e.g., Razorpay, PhonePe), voicensms.in (OTP delivery), cloud storage providers, AI / image-analysis providers (powering photo analysis and recommendations), and analytics tools.
• These services operate under their own terms and privacy policies. We are not responsible for their independent functionality or policies.

12. Suspension & Termination

We may suspend or terminate your account if:

• You violate these Terms or applicable law.
• Payments fail, are disputed, or chargedback.
• You upload prohibited imagery or misuse the Platform in ways that harm other users or the Platform.
• Required by court order or government authority.

13. Limitation of Liability

To the maximum extent permitted by law:

• The Platform is provided on an “as is” and “as available” basis.
• We do not guarantee uninterrupted or error-free service, or the accuracy of any rating or recommendation.
• We are not liable for any indirect, consequential, or incidental damages, or for decisions you make based on the App’s ratings or recommendations.

14. Indemnification

You agree to indemnify and hold harmless HouseofTech Innovation Pvt Ltd, its officers, employees, and partners from any claims arising from:

• Your use or misuse of the Platform or its content
• Your violation of these Terms
• Photos or content you upload, including any infringement of another person’s rights

15. Privacy Policy

Your use of Rizzup is also governed by our Privacy Policy, which explains how your data and photos are collected and used.

16. Modifications to Terms

• We may update these Terms at any time. Material changes will be communicated through the App.
• Continued use of the Platform after updates means you accept the revised Terms.

17. Governing Law & Jurisdiction

• These Terms are governed by the laws of India.
• Disputes shall fall under the exclusive jurisdiction of courts in Gurgaon, Haryana.
