These Terms and Conditions (“Terms”) govern your access to and use of the PosterPro AI mobile application, website, software, and related services (collectively, the “Platform”), operated by HouseofTech Innovation Pvt Ltd (“we”, “us”, “our”, or the “Company”).

By accessing, downloading, registering, or using the Platform, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.

1. About the Platform

PosterPro AI makes AI-personalised posters from templates using your photo and name. You select a poster template, type the name you want printed on it, upload one of your own photos, and the Platform uses artificial intelligence to place you into the template and render a finished poster. Certain templates and features are available only to paid subscribers.

2. AI-Generated Content & Its Limitations

• Rendered posters may unintentionally resemble existing designs, people, or works. You are responsible for how you use them.
• Identical or similar inputs may produce different posters, and quality varies by photo, template, and device.
• We may add invisible or visible markers / watermarks to AI-rendered posters where required by law or platform policy.

3. Eligibility

• You must be at least 13 years old to use the Platform.
• If you are under 18, you must use the Platform under parental or guardian supervision.
• By using the Platform, you confirm that you have the legal capacity to accept these Terms.

4. Account Registration

• Account creation is required for most features and is performed via mobile-number OTP verification.
• You are responsible for the security of your registered phone number, email, and OTP.
• You agree to provide accurate and complete information.
• We may suspend or terminate accounts with false, misleading, or shared credentials.

5. Your Photos & Posters — Ownership & License

• You retain all rights you hold in the photos you upload and the name you type and, to the extent permitted by law, in the posters rendered for you.
• You grant us a limited, worldwide, non-exclusive license to host, store, process, and transform your uploaded photos and typed text solely to operate the service and render the posters you request. This license ends when your content is deleted from our systems (see Privacy Policy).
• You confirm that you own or have all rights and consents necessary to upload each photo and to use each name you type — including the consent of every identifiable person shown or named — and that doing so does not infringe any third-party right or law.
• We do not claim ownership of your posters, but we may use anonymised, non-identifying examples to demonstrate templates only with your consent or where the example contains no personal data.

6. Acceptable Use — What You May Not Upload or Create

You agree not to upload or create:

• Photos or names of other people without their consent, or any content that violates a person’s privacy, publicity, or likeness rights.
• Content intended to deceive or harm — e.g., posters presented as real endorsements, impersonation of real people, fake documents, fraud, or misinformation.
• Sexual, nude, or explicit content; non-consensual intimate imagery; or any sexualised content involving minors (strictly prohibited and reported to authorities).
• Content that is hateful, harassing, defamatory, or that incites violence against any individual, community, religion, or caste.
• Content that infringes copyright, trademark, or other intellectual-property rights.
• Photos of children without the consent of a parent or guardian.
• Any content that is unlawful, abusive, or harmful, or that attempts to bypass safety filters.

We may review, refuse, moderate, remove, or restrict any input or poster, and suspend accounts that violate these rules, without prior notice. You are solely responsible for the photos and names you submit and for how you use the posters.

7. License & Usage Rights to Templates

• We grant you a limited, non-exclusive, non-transferable, revocable license to use the poster templates and AI features for creating posters for your personal or permitted use.
• You may not resell, sublicense, redistribute, scrape, bulk-export, reverse engineer, or commercially exploit the templates, models, or software themselves.
• You may not remove watermarks, branding, or copyright notices except where the App expressly allows it for your own posters.

8. Subscription, Pricing & Payments

• Premium templates, higher poster limits, faster rendering, watermark-free posters, and other pro features are available through the paid PosterPro Pro plan.
• Current pricing is displayed inside the App and on the paywall screen at the time of purchase.
• Prices are inclusive of applicable taxes unless stated otherwise. Prices may change at any time without prior notice; existing active subscriptions remain at the price agreed at purchase until renewal.
• Payments are processed by RBI-licensed payment gateway partners (such as Razorpay, PhonePe, or similar providers). The active payment gateway may change from time to time without prior notice. Supported methods include UPI, UPI AutoPay, cards, and netbanking.
• We do not store your full card or banking details on our servers.
• Subscriptions auto-renew via UPI AutoPay or card mandate until cancelled. See our Payment & Cancellation Policy for full details.

9. Refund & Cancellation

• You may cancel auto-renewal at any time before the next billing cycle. Cancellation prevents future charges; current period access continues until expiry.
• Because posters are rendered on demand using paid compute, and because AI output is inherently variable, all completed payments and posters already rendered are non-refundable except where required by applicable law or as described in the Cancellation Policy.

10. Intellectual Property Rights

• All poster templates, designs, branding, AI pipelines, and software on the Platform are owned by or licensed to HouseofTech Innovation Pvt Ltd (other than the photos and names you submit and the posters rendered for you).
• You receive a personal-use license to the Platform only; no ownership of the Platform, templates, or models transfers to you.
• Unauthorised commercial reproduction or redistribution of the Platform’s templates or software may result in legal action under the Copyright Act, 1957 and related laws.

11. Third-Party Services

• The Platform integrates third-party services such as generative AI image model providers, payment gateway partners (e.g., Razorpay, PhonePe), voicensms.in (OTP delivery), cloud storage and content-delivery providers, and analytics tools.
• These services operate under their own terms and privacy policies. We are not responsible for their independent functionality or policies.

12. Suspension & Termination

We may suspend or terminate your account if:

• You violate these Terms or applicable law (including the acceptable-use rules in Section 6).
• Payments fail, are disputed, or charged back.
• You upload or create content that harms others, infringes rights, or abuses the Platform.
• Required by court order or government authority.

13. Limitation of Liability

To the maximum extent permitted by law:

• The Platform and its AI-rendered posters are provided on an “as is” and “as available” basis.
• We do not guarantee uninterrupted, error-free service, or that any poster will be accurate, suitable, or fit for a particular purpose.
• You are solely responsible for how you use your posters, including compliance with the laws of your jurisdiction and the rights of any people depicted or named.
• We are not liable for any indirect, consequential, or incidental damages, or for any loss arising from your use of AI-rendered posters or from content uploaded or created by users.

14. Indemnification

You agree to indemnify and hold harmless HouseofTech Innovation Pvt Ltd, its officers, employees, and partners from any claims arising from:

• Your use or misuse of the Platform or its posters
• The photos you upload, the names you type, and the posters you create
• Your violation of these Terms
• Your infringement of any third-party right, including intellectual property, privacy, and right of publicity / likeness

15. Privacy Policy

Your use of PosterPro AI is also governed by our Privacy Policy, which explains how your data, uploaded photos and posters are collected, processed, and deleted.

16. Modifications to Terms

• We may update these Terms at any time. Material changes will be communicated through the App.
• Continued use of the Platform after updates means you accept the revised Terms.

17. Governing Law & Jurisdiction

• These Terms are governed by the laws of India.
• Disputes shall fall under the exclusive jurisdiction of courts in Gurgaon, Haryana.
