These Terms and Conditions (“Terms”) govern your access to and use of the Pashudhan mobile application, website, software, and related services (collectively, the “Platform”), operated by HouseofTech Innovation Pvt Ltd (“we”, “us”, “our”, or the “Company”).

By accessing, downloading, registering, or using the Platform, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.

1. About the Platform

Pashudhan is a short-video app for farmers and the rural community, offering a feed of short videos on agriculture, livestock and dairy care, animal husbandry, crop and farming techniques, government schemes, market awareness, and other educational and informational content. Content is curated, licensed, created by the Company, or contributed by users; certain content and features are available only to paid subscribers.

2. Eligibility

• You must be at least 13 years old to use the Platform.
• If you are under 18, you must use the Platform under parental or guardian supervision.
• By using the Platform, you confirm that you have the legal capacity to accept these Terms.

3. Account Registration

• Account creation is required for most features and is performed via OTP-based mobile verification.
• You are responsible for the security of your registered phone number and OTP.
• You agree to provide accurate and complete information.
• We may suspend or terminate accounts with false, misleading, or shared credentials.

4. License & Usage Rights

4.1 License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to access and view the videos and other content on the Platform for your personal, non-commercial use only.

4.2 Restrictions

You agree not to:

• Resell, sublicense, redistribute, re-upload, or commercially exploit any video, image, audio, or other content from the Platform.
• Re-publish Platform content on other social media, websites, file-sharing services, or third-party content stores, except via the in-app share feature where provided.
• Modify, edit, or remove watermarks, branding, or copyright notices from any Platform content.
• Use Platform content to defame, demean, or incite hatred against any community, religion, caste, or individual.
• Reverse engineer, scrape, bulk-download, or attempt to extract source code, content databases, or APIs.
• Use the Platform for unlawful, abusive, misleading, or harmful purposes.
• Share your account, OTP, or active subscription with others.

5. User-Generated Content

If the App allows you to upload, post, or share videos, photos, comments, or other material (“User Content”):

• You retain ownership of your User Content, but you grant the Company a worldwide, royalty-free, non-exclusive licence to host, store, display, reproduce, distribute, and promote it within and in connection with the Platform.
• You confirm that you own or have all rights necessary to post the User Content and that it does not infringe any third-party right or law.
• You must not post content that is false, misleading, obscene, defamatory, hateful, fraudulent, or that gives unsafe or unlawful advice (including dangerous veterinary, medical, or chemical practices).
• We may, at our discretion, review, moderate, remove, or restrict any User Content, and suspend accounts that repeatedly violate these Terms, without prior notice.
• You are solely responsible for your User Content and any consequences of posting it.

6. Subscription, Pricing & Payments

• Premium content and features are available through paid subscription plans.
• Current pricing is displayed inside the App and on the paywall screen at the time of purchase.
• Prices are in INR and inclusive of applicable taxes unless stated otherwise. Prices may change at any time without prior notice; existing active subscriptions remain at the price agreed at purchase until renewal.
• Payments are processed securely via RBI-licensed payment gateway partners (such as Razorpay, PhonePe, or similar providers) supporting UPI, cards, netbanking, and UPI Autopay. The active payment gateway may change from time to time without prior notice.
• We do not store your full card or banking details on our servers.
• Subscriptions auto-renew via UPI Autopay or card mandate until cancelled. See our Payment & Cancellation Policy for full details.

7. Refund & Cancellation

• You may cancel auto-renewal at any time before the next billing cycle. Cancellation prevents future charges; current period access continues until expiry.
• Due to the digital nature of the content, all completed payments are non-refundable except where required by applicable law.

8. Content Disclaimer — Informational Only

• Pashudhan content is published for general education, awareness, and informational purposes for farmers. It is not professional veterinary, medical, agronomic, financial, or legal advice.
• Always consult a qualified veterinarian, agricultural officer, Krishi Vigyan Kendra (KVK), or other licensed professional before acting on any technique, treatment, dosage, chemical, fertiliser, pesticide, or financial decision shown in a video.
• Information about government schemes, subsidies, mandi prices, and dates is provided in good faith and may change; verify with official sources before relying on it.
• We do not guarantee any specific yield, income, animal-health, or other outcome from using the Platform or its content. You use the information at your own risk.

9. User Conduct

• You are responsible for the lawful and respectful use of the Platform and any content accessed through it.
• Do not use the Platform to harass, threaten, spam, or incite violence against any individual, community, or religion.
• Misuse may result in suspension or termination of your account and reporting to authorities where applicable.

10. Intellectual Property Rights

• All videos, audio, images, designs, branding, and software on the Platform are owned by, licensed to, or licensed by HouseofTech Innovation Pvt Ltd from rights holders (other than User Content owned by its contributors).
• You receive a personal-use license only; no ownership transfers to you.
• Unauthorised commercial reproduction, redistribution, or modification may result in legal action under the Copyright Act, 1957 and related laws.

11. Third-Party Services

• The Platform integrates third-party services such as payment gateway partners (e.g., Razorpay, PhonePe), voicensms.in (OTP delivery), cloud storage and content-delivery providers, and analytics tools.
• These services operate under their own terms and privacy policies. We are not responsible for their independent functionality or policies.

12. Suspension & Termination

We may suspend or terminate your account if:

• You violate these Terms or applicable law.
• Payments fail, are disputed, or chargedback.
• You post or misuse content in ways that harm rights holders, other users, or the Platform.
• Required by court order or government authority.

13. Limitation of Liability

To the maximum extent permitted by law:

• The Platform is provided on an “as is” and “as available” basis.
• We do not guarantee uninterrupted or error-free service.
• We are not liable for any indirect, consequential, or incidental damages, or for any loss arising from reliance on content or from misuse of content by users or third parties.

14. Indemnification

You agree to indemnify and hold harmless HouseofTech Innovation Pvt Ltd, its officers, employees, and partners from any claims arising from:

• Your use or misuse of the Platform or its content
• Your User Content
• Your violation of these Terms
• Your infringement of any third-party right, including intellectual property and right of publicity

15. Privacy Policy

Your use of Pashudhan is also governed by our Privacy Policy, which explains how your data is collected and used.

16. Modifications to Terms

• We may update these Terms at any time. Material changes will be communicated through the App.
• Continued use of the Platform after updates means you accept the revised Terms.

17. Governing Law & Jurisdiction

• These Terms are governed by the laws of India.
• Disputes shall fall under the exclusive jurisdiction of courts in Gurgaon, Haryana.
