These Terms and Conditions (“Terms”) govern your access to and use of the Looksy mobile application, website, software, and related services (collectively, the “Platform”), operated by HouseofTech Innovation Pvt Ltd (“we”, “us”, “our”, or the “Company”).

By accessing, downloading, registering, or using the Platform, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.

1. About the Platform

Looksy is an AI photo and video maker. You select a template or style, upload one or more of your own photos, and the Platform uses artificial intelligence to generate new photos and videos. Certain templates, styles, and features are available only to paid subscribers.

2. AI-Generated Content & Its Limitations

• Generated images and videos may unintentionally resemble existing styles, people, or works. You are responsible for how you use the outputs.
• Identical or similar inputs may produce different results, and quality varies by photo, template, and device.
• We may add invisible or visible markers / watermarks to AI-generated outputs where required by law or platform policy.

3. Eligibility

• You must be at least 13 years old to use the Platform.
• If you are under 18, you must use the Platform under parental or guardian supervision.
• By using the Platform, you confirm that you have the legal capacity to accept these Terms.

4. Account Registration

• Account creation is required for most features and is performed via OTP / account-based verification.
• You are responsible for the security of your registered phone number, email, and OTP.
• You agree to provide accurate and complete information.
• We may suspend or terminate accounts with false, misleading, or shared credentials.

5. Your Photos & Generated Results — Ownership & License

• You retain all rights you hold in the photos you upload and, to the extent permitted by law, in the results generated for you.
• You grant us a limited, worldwide, non-exclusive license to host, store, process, and transform your uploaded photos solely to operate the service and generate your requested results. This license ends when your content is deleted from our systems (see Privacy Policy).
• You confirm that you own or have all rights and consents necessary to upload each photo — including the consent of every identifiable person shown in it — and that doing so does not infringe any third-party right or law.
• We do not claim ownership of your AI-generated results, but we may use anonymised, non-identifying examples to demonstrate templates only with your consent or where the example contains no personal data.

6. Acceptable Use — What You May Not Upload or Generate

You agree not to upload or generate:

• Photos of other people without their consent, or any content that violates a person’s privacy, publicity, or likeness rights.
• Content intended to deceive or harm — e.g., deepfakes presented as real, impersonation of real people, fake documents, fraud, or misinformation.
• Sexual, nude, or explicit content; non-consensual intimate imagery; or any sexualised content involving minors (strictly prohibited and reported to authorities).
• Content that is hateful, harassing, defamatory, or that incites violence against any individual, community, religion, or caste.
• Content that infringes copyright, trademark, or other intellectual-property rights.
• Photos of children without the consent of a parent or guardian.
• Any content that is unlawful, abusive, or harmful, or that attempts to bypass safety filters.

We may review, refuse, moderate, remove, or restrict any input or output, and suspend accounts that violate these rules, without prior notice. You are solely responsible for the photos you upload and for how you use the results.

7. License & Usage Rights to Templates

• We grant you a limited, non-exclusive, non-transferable, revocable license to use the templates, styles, and AI features for creating results for your personal or permitted use.
• You may not resell, sublicense, redistribute, scrape, bulk-export, reverse engineer, or commercially exploit the templates, models, or software themselves.
• You may not remove watermarks, branding, or copyright notices except where the App expressly allows it for your own results.

8. Subscription, Pricing & Payments

• Premium templates, higher generation limits, faster processing, watermark-free results, and other pro features are available through paid subscription plans (and, where offered, credits / generation packs).
• Current pricing is displayed inside the App and on the paywall screen at the time of purchase.
• Prices are in INR and inclusive of applicable taxes unless stated otherwise. Prices may change at any time without prior notice; existing active subscriptions remain at the price agreed at purchase until renewal.
• Payments are processed securely via RBI-licensed payment gateway partners (such as Razorpay, PhonePe, or similar providers) supporting UPI, cards, netbanking, and UPI Autopay. The active payment gateway may change from time to time without prior notice.
• We do not store your full card or banking details on our servers.
• Subscriptions auto-renew via UPI Autopay or card mandate until cancelled. See our Payment & Cancellation Policy for full details.

9. Refund & Cancellation

• You may cancel auto-renewal at any time before the next billing cycle. Cancellation prevents future charges; current period access continues until expiry.
• Because results are generated on demand using paid compute, and because outputs are inherently variable, all completed payments and consumed generations / credits are non-refundable except where required by applicable law or as described in the Cancellation Policy.

10. Intellectual Property Rights

• All templates, styles, designs, branding, AI pipelines, and software on the Platform are owned by or licensed to HouseofTech Innovation Pvt Ltd (other than the photos you upload and the results generated for you).
• You receive a personal-use license to the Platform only; no ownership of the Platform, templates, or models transfers to you.
• Unauthorised commercial reproduction or redistribution of the Platform’s templates or software may result in legal action under the Copyright Act, 1957 and related laws.

11. Third-Party Services

• The Platform integrates third-party services such as generative AI model providers, payment gateway partners (e.g., Razorpay, PhonePe), voicensms.in (OTP delivery), cloud storage and content-delivery providers, and analytics tools.
• These services operate under their own terms and privacy policies. We are not responsible for their independent functionality or policies.

12. Suspension & Termination

We may suspend or terminate your account if:

• You violate these Terms or applicable law (including the acceptable-use rules in Section 6).
• Payments fail, are disputed, or charged back.
• You upload or generate content that harms others, infringes rights, or abuses the Platform.
• Required by court order or government authority.

13. Limitation of Liability

To the maximum extent permitted by law:

• The Platform and its AI outputs are provided on an “as is” and “as available” basis.
• We do not guarantee uninterrupted, error-free service, or that any generated result will be accurate, suitable, or fit for a particular purpose.
• You are solely responsible for how you use generated images and videos, including compliance with the laws of your jurisdiction and the rights of any people depicted.
• We are not liable for any indirect, consequential, or incidental damages, or for any loss arising from your use of AI-generated outputs or from content uploaded or generated by users.

14. Indemnification

You agree to indemnify and hold harmless HouseofTech Innovation Pvt Ltd, its officers, employees, and partners from any claims arising from:

• Your use or misuse of the Platform or its outputs
• The photos you upload and the results you generate
• Your violation of these Terms
• Your infringement of any third-party right, including intellectual property, privacy, and right of publicity / likeness

15. Privacy Policy

Your use of Looksy is also governed by our Privacy Policy, which explains how your data and uploaded photos are collected, processed, and deleted.

16. Modifications to Terms

• We may update these Terms at any time. Material changes will be communicated through the App.
• Continued use of the Platform after updates means you accept the revised Terms.

17. Governing Law & Jurisdiction

• These Terms are governed by the laws of India.
• Disputes shall fall under the exclusive jurisdiction of courts in Gurgaon, Haryana.
