HouseofTech Innovation Pvt Ltd (“we”, “us”, “our”, or the “Company”) operates the Looksy mobile application (the “App”).

Looksy is an AI photo and video maker. You choose from a library of templates and styles, upload one or more of your own photos, and the App uses artificial intelligence to generate new photos and videos based on those inputs. Certain templates, styles, and features are available only to paid subscribers.

We are committed to protecting your privacy and handling your personal data — especially the photos you upload — responsibly. This Privacy Policy explains how we collect, use, store, share, and protect your information when you use Looksy.

By downloading, installing, or using Looksy, you agree to the practices described in this Privacy Policy. If you do not agree, please do not use the App.

1. Information We Collect

A. Information You Provide Directly

• Mobile phone number or email (used for OTP / account-based login).
• Optional profile information such as name, preferred language, and notification preferences.
• Photos and images you upload to generate AI results, and any optional text prompts, template selections, or style choices you make.
• The AI-generated photos and videos created for you (your output history / gallery).
• Subscription and billing-related details when purchasing a premium plan.
• Feedback, support queries, or communications you send to us.

B. Automatically Collected Information

• Device information: device type, operating system, app version, IP address, unique device identifiers.
• Usage data: templates used, number of generations created, features used, time spent in the App.
• Performance data: crash reports, diagnostics, and error logs.
• Analytics data collected via third-party tools to improve the App.

C. Permissions We May Request

• Photos / storage / gallery — only to let you select the photos you want to use for generation, and to save generated results to your device.
• Camera — only if you choose to take a new photo directly in the App for generation. Not accessed otherwise.
• Notifications — only to alert you when a generation is ready or for service messages.
• You can deny or revoke these permissions at any time from your device settings; the rest of the App will continue to work, though photo generation requires access to a photo.

D. Face & Photo Data

• Many templates (e.g., portraits, avatars, face swaps, styled looks) detect and process faces in the photos you upload in order to apply the requested effect.
• Facial geometry is processed transiently, only to generate your requested output. We do not use it to identify you, do not build a facial-recognition database, and do not share it for advertising.
• Any face data is deleted together with the associated uploaded photos within the retention window described in Section 6.

E. Information We Do Not Collect

• We do not access your contact list, SMS, or call logs.
• We do not collect government IDs or biometric identifiers for identification purposes.
• We do not store your full card or UPI details — payment information is handled directly by our payment gateway partner.

2. How We Use Your Information

• Authenticate your account and maintain secure login sessions.
• Process the photos you upload and generate the AI photos and videos you request from your selected templates.
• Store your generation history so you can view, re-download, or re-use your results in the App.
• Process subscription payments and manage billing.
• Send service messages such as OTP, “your result is ready” notices, payment receipts, and important account notices.
• Detect and prevent fraud, abuse, misuse, or unauthorised access.
• Improve App performance, fix bugs, and develop new templates and features.

3. AI Processing & Third-Party AI Providers

• To create your results, the photos and prompts you submit are processed on our secure cloud infrastructure and may be sent to third-party AI model providers (such as generative image and video model APIs).
• Photos and prompts sent to these providers are used solely to generate your requested output and are not retained by them for advertising or for training models without your consent, in line with their enterprise terms.
• Generated results are created by AI and may be imperfect, inaccurate, or differ from what you expect — see our Terms & Conditions for usage rules.

4. Subscription & Payment Information

• Payments are handled by RBI-licensed payment gateway partners (such as Razorpay, PhonePe, or similar providers) using UPI, cards, netbanking, and UPI Autopay. The active payment gateway may change from time to time without prior notice.
• The payment gateway partner processes and stores card and UPI mandate details under its own security and privacy policies.
• We retain only your subscription status, plan, and transaction reference for billing and tax compliance.

5. Information Sharing & Disclosure

We do not sell or rent your personal data. We share limited data only:

• With service providers (cloud hosting, AI model providers, content delivery networks, payment gateway partners such as Razorpay or PhonePe, OTP delivery via voicensms.in, analytics) under data-protection agreements.
• To comply with legal obligations, court orders, or lawful government requests.
• In case of mergers, acquisitions, or restructuring (with notice to users).
• To protect rights, safety, and platform security.

6. Data Storage, Security & Retention

• We use industry-standard safeguards including encryption in transit (HTTPS/TLS) and access controls.
• Data is stored on cloud infrastructure (including outside India) with appropriate safeguards.
• Uploaded source photos and generated results are stored for processing and for your in-app history/gallery, and are automatically deleted from our processing servers within a limited period (typically up to 30 days) unless you keep them saved in your account.
• Results you download or export to your own device or cloud are under your control and are not affected by our retention windows.
• Transaction records are retained for the duration required by Indian tax and accounting law (typically up to 7 years).
• Analytics data may be retained in anonymised form for up to 24 months.
• While we take strong precautions, no system is completely secure.
• You may request account and data deletion at any time — see the Delete Account page.

7. Your Privacy Rights

Under applicable laws (including the Digital Personal Data Protection Act, 2023), you may have the right to:

• Access your personal data
• Correct or update your information
• Request deletion of your data and uploaded photos
• Withdraw consent
• File a complaint with authorities

8. Children’s Privacy

• Looksy is intended for users aged 13 and above.
• Users under 18 should use the App with parental or guardian guidance.
• We do not knowingly collect data from children below 13. Do not upload photos of children without the consent of their parent or guardian.

9. Third-Party Services

• The App may use third-party tools including generative AI model providers, Razorpay (payments), voicensms.in (OTP), cloud storage and content-delivery providers, and analytics services.
• These services operate under their own privacy policies.

10. Changes to This Privacy Policy

• We may update this Privacy Policy from time to time.
• Significant changes will be communicated through the App.
• Continued use of Looksy means acceptance of the updated policy.
