These Terms and Conditions (“Terms”) govern your access to and use of the Dharmik mobile application, website, software, and related services (collectively, the “Platform”), operated by HouseofTech Innovation Pvt Ltd (“we”, “us”, “our”, or the “Company”).

By accessing, downloading, registering, or using the Platform, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.

1. About the Platform

Dharmik is a devotional app that offers religious content such as ringtones, notification tones, wallpapers, images, mantras, aartis, bhajans, and related devotional material that you can browse, download, and set on your device. Some content is free; premium content and features require a paid subscription or in-app purchase.

2. Devotional Content & Its Nature

• Content such as ringtones, wallpapers, and images is provided for personal, non-commercial devotional use.
• Interpretations of mantras, texts, dates, and rituals may vary across traditions; content is provided for general reference and is not a religious ruling.
• Content libraries may be updated, replaced, or removed at any time.
• Feature availability, content libraries, and quality may vary by region, device, plan, language, and server load.

3. Eligibility

• You must be at least 13 years old (or the higher minimum age required in your country, e.g. 16 in parts of the EEA) to use the App, and at least 18 (or the age of majority where you live) to purchase a subscription.
• By using the Platform, you confirm that you have the legal capacity to accept these Terms.

4. Account Registration

• You may use parts of the App without an account; to save favourites or subscribe you may sign up using your email address or a supported identity provider (Google, Apple).
• You are responsible for the security of your account credentials and for all activity under your account.
• You agree to provide accurate and complete information.
• We may suspend or terminate accounts with false, misleading, or shared credentials.

5. Device Permissions

• To download content and set ringtones, notification tones, and wallpapers, the App may request permissions such as storage/media access and the ability to modify system sound settings or set wallpaper.
• These permissions are used only to deliver the features you request. You may revoke them from your device settings, though some features will then be unavailable.

6. Content Ownership & Your Use

• All ringtones, audio, wallpapers, images, text, graphics, branding, and other materials made available in the App (the “Content”) are owned by or licensed to HouseofTech Innovation Pvt Ltd or their respective rights holders, and are protected by intellectual-property laws.
• We grant you a limited, non-exclusive, non-transferable, revocable license to download and use the Content for your own personal, non-commercial devotional use, while your account and (where applicable) subscription are active.
• You may not resell, redistribute, publicly perform, sublicense, or create derivative works from the Content, or use it for commercial purposes, without our written permission.

7. Acceptable Use & Restrictions

You agree not to:

• Resell, sublicense, or commercially redistribute the App, the Content, or your subscription, or provide access to third parties via automation/scraping.
• Reverse engineer or attempt to extract source code, models, or proprietary systems.
• Circumvent usage limits, paywalls, geo-restrictions, or content protections.
• Use the Platform for any unlawful, fraudulent, abusive, or harmful purpose, or to promote hatred against any community, faith, or belief.
• Share your account or active subscription with others.

8. Subscription, Pricing & Payments

• Premium content and features are available through paid subscription plans and/or one-time in-app purchases.
• Current pricing is displayed inside the App at the time of purchase, in your local currency where supported. Prices may vary by region and may change at any time; existing active subscriptions remain at the agreed price until renewal.
• Payments are processed by Google Play Billing (Android), Apple In-App Purchase / Apple Pay (iOS), or licensed payment processors such as Razorpay (web and supported regions), supporting credit/debit cards and local payment methods. The active processor may change without prior notice.
• We do not store your full card or banking details on our servers.
• Subscriptions auto-renew until cancelled. Purchases made through Google Play or the Apple App Store are also subject to Google’s and Apple’s own terms and refund policies. See our Payment & Cancellation Policy for full details.
• Prices may be exclusive of taxes (VAT, GST, sales tax) depending on your region; any applicable taxes are shown at checkout or applied by the app store.

9. Refund & Cancellation

• You may cancel auto-renewal at any time before the next billing cycle. Cancellation prevents future charges; current period access continues until expiry.
• Purchases via Google Play or the Apple App Store follow the refund policies of those stores. For direct purchases (e.g., via Razorpay), completed payments are non-refundable except as described in our policy or where required by applicable consumer law (including any statutory withdrawal/cooling-off rights in your country).

10. Disclaimer

• Dharmik provides devotional content for personal use. Content is provided on an “as is” basis and is not guaranteed to be accurate, complete, or authoritative for any particular tradition or ritual.
• We do not guarantee any specific spiritual, religious, or other outcome.
• You are solely responsible for how you use the Content, including compliance with the laws and customs of your jurisdiction.

11. Intellectual Property & Third-Party Rights

• All software, design, branding, and Content on the Platform are owned by or licensed to HouseofTech Innovation Pvt Ltd or their respective rights holders.
• You receive a personal-use license only; no ownership of the Platform or Content transfers to you.
• If you are a rights holder and believe content infringes your rights, contact us at the email below and we will review and, where appropriate, remove it.

12. Third-Party Services

• The Platform integrates third-party services such as payment processors (Google Play Billing, Apple In-App Purchase, Razorpay), sign-in providers (Google, Apple), cloud storage and content-delivery networks, and analytics tools.
• These services operate under their own terms and privacy policies. We are not responsible for their independent functionality or policies.

13. Suspension & Termination

We may suspend or terminate your account if:

• You violate these Terms, our usage rules, or applicable law.
• Payments fail, are disputed, or charged back.
• You misuse the App in ways that harm other users or the Platform.
• Required by court order or government authority.

14. Limitation of Liability

To the maximum extent permitted by law:

• The Platform is provided on an “as is” and “as available” basis.
• We do not guarantee uninterrupted, error-free, or always-accurate service or content.
• We are not liable for any indirect, consequential, or incidental damages, or for any loss arising from your reliance on the Content.
• Our total aggregate liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.
• Nothing in these Terms excludes liability that cannot be excluded under applicable law, or limits any non-waivable statutory consumer rights in your country of residence.

15. Indemnification

You agree to indemnify and hold harmless HouseofTech Innovation Pvt Ltd, its officers, employees, and partners from any claims arising from:

• Your use or misuse of the Platform or its Content
• Your violation of these Terms
• Your infringement of any third-party right

16. Privacy Policy

Your use of Dharmik is also governed by our Privacy Policy, which explains how your personal data and device permissions are handled.

17. Modifications to Terms

• We may update these Terms at any time. Material changes will be communicated through the App.
• Continued use of the Platform after updates means you accept the revised Terms.

18. Governing Law & Jurisdiction

• These Terms are governed by the laws of India, without prejudice to any mandatory consumer-protection rules of the country where you habitually reside.
• Subject to such mandatory rules, disputes shall fall under the exclusive jurisdiction of courts in Gurgaon, Haryana, India.
