These Terms and Conditions (“Terms”) govern your access to and use of the AI Photo Editor mobile application, website, software, and related services (collectively, the “Platform”), operated by HouseofTech Innovation Pvt Ltd (“we”, “us”, “our”, or the “Company”).

By accessing, downloading, registering, or using the Platform, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.

1. About the Platform

AI Photo Editor lets you enhance, retouch, restyle, and transform photos using artificial-intelligence models — including AI portraits, background removal, photo enhancement, filters, and creative styles. Some features are free; premium features require a paid subscription or in-app purchase.

2. AI-Generated Content & Its Limitations

• AI models are probabilistic: the same input can produce different outputs, and artefacts (distorted features, altered details, unrealistic elements) can occur.
• Generated images may unintentionally resemble existing styles, people, or works. You are responsible for how you use the outputs.
• We may add invisible or visible markers/watermarks to AI-generated outputs where required by law or platform policy.
• Feature availability, processing speed, and quality may vary by region, device, plan, and server load.

3. Eligibility

• You must be at least 13 years old (or the higher minimum age required in your country, e.g. 16 in parts of the EEA) to use the App, and at least 18 (or the age of majority where you live) to purchase a subscription.
• By using the Platform, you confirm that you have the legal capacity to accept these Terms.

4. Account Registration

• You may sign up using your email address or a supported identity provider (Google, Apple).
• You are responsible for the security of your account credentials and for all activity under your account.
• You agree to provide accurate and complete information.
• We may suspend or terminate accounts with false, misleading, or shared credentials.

5. Your Content & License to Us

5.1 Your photos remain yours

• You retain all rights you hold in the photos you upload and, to the extent permitted by law, in the edited results generated for you.
• You grant us a limited, worldwide, non-exclusive license to host, process, and transform your uploaded photos solely to operate the service and generate your requested results. This license ends when your content is deleted from our systems.
• We do not use your photos for advertising and do not use them to train AI models without your explicit consent. See our Privacy Policy.

5.2 Content rules

You agree not to upload or generate:

• Photos of any person without the right or permission to use their image, or content that violates anyone’s privacy, publicity, or intellectual-property rights.
• Sexually explicit content, child sexual abuse material (zero tolerance — reported to authorities), or sexualised images of minors in any form.
• Content intended to deceive — e.g., deepfakes presented as real, impersonation of real people, fraudulent documents, or misinformation.
• Content that is hateful, harassing, violent, or otherwise unlawful in your jurisdiction.

We may use automated and manual moderation to enforce these rules and may remove content or suspend accounts that violate them.

6. License & Usage Rights

6.1 License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Platform for your own personal or internal business purposes.

6.2 Restrictions

You agree not to:

• Resell, sublicense, or commercially redistribute the App or its features, or provide the service to third parties via automation/API scraping.
• Reverse engineer or attempt to extract source code, models, or prompts.
• Circumvent usage limits, paywalls, or content-safety filters.
• Use the Platform for any unlawful, fraudulent, abusive, or harmful purpose.
• Share your account or active subscription with others.

7. Subscription, Pricing & Payments

• Premium features are available through paid subscription plans and/or one-time in-app purchases (e.g., credit packs).
• Current pricing is displayed inside the App at the time of purchase, in your local currency where supported. Prices may vary by region and may change at any time; existing active subscriptions remain at the agreed price until renewal.
• Payments are processed by Google Play Billing (Android), Apple In-App Purchase / Apple Pay (iOS), or licensed payment processors such as Razorpay (web and supported regions), supporting credit/debit cards and local payment methods. The active processor may change without prior notice.
• We do not store your full card or banking details on our servers.
• Subscriptions auto-renew until cancelled. Purchases made through Google Play or the Apple App Store are also subject to Google’s and Apple’s own terms and refund policies. See our Payment & Cancellation Policy for full details.
• Prices may be exclusive of taxes (VAT, GST, sales tax) depending on your region; any applicable taxes are shown at checkout or applied by the app store.

8. Refund & Cancellation

• You may cancel auto-renewal at any time before the next billing cycle. Cancellation prevents future charges; current period access continues until expiry.
• Purchases via Google Play or the Apple App Store follow the refund policies of those stores. For direct purchases (e.g., via Razorpay), completed payments are non-refundable except as described in our policy or where required by applicable consumer law (including any statutory withdrawal/cooling-off rights in your country).

9. Disclaimer

• AI Photo Editor is a creative tool. Outputs are AI-generated and are not guaranteed to be accurate, suitable, or fit for any particular purpose.
• We do not guarantee that every edit will succeed, render correctly, or meet your expectations.
• You are solely responsible for how you use generated images, including compliance with the laws of your jurisdiction and the rights of any people depicted.

10. Intellectual Property Rights

• All software, design, branding, models, and content on the Platform (excluding your photos) are owned by or licensed to HouseofTech Innovation Pvt Ltd.
• You receive a personal-use license only; no ownership of the Platform transfers to you.
• Unauthorised commercial reproduction, redistribution, or modification may result in legal action.

11. Third-Party Services

• The Platform integrates third-party services such as payment processors (Google Play Billing, Apple In-App Purchase, Razorpay), sign-in providers (Google, Apple), cloud storage, AI infrastructure providers, and analytics tools.
• These services operate under their own terms and privacy policies. We are not responsible for their independent functionality or policies.

12. Suspension & Termination

We may suspend or terminate your account if:

• You violate these Terms, our content rules, or applicable law.
• Payments fail, are disputed, or charged back.
• You misuse the App in ways that harm other users or the Platform.
• Required by court order or government authority.

13. Limitation of Liability

To the maximum extent permitted by law:

• The Platform is provided on an “as is” and “as available” basis.
• We do not guarantee uninterrupted, error-free, or always-accurate service.
• We are not liable for any indirect, consequential, or incidental damages, or for any loss arising from your use of AI-generated outputs.
• Our total aggregate liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.
• Nothing in these Terms excludes liability that cannot be excluded under applicable law, or limits any non-waivable statutory consumer rights in your country of residence.

14. Indemnification

You agree to indemnify and hold harmless HouseofTech Innovation Pvt Ltd, its officers, employees, and partners from any claims arising from:

• Your use or misuse of the Platform or its outputs
• Your violation of these Terms
• Your infringement of any third-party right, including the rights of people depicted in photos you upload

15. Privacy Policy

Your use of AI Photo Editor is also governed by our Privacy Policy, which explains how your photos and personal data are handled.

16. Modifications to Terms

• We may update these Terms at any time. Material changes will be communicated through the App.
• Continued use of the Platform after updates means you accept the revised Terms.

17. Governing Law & Jurisdiction

• These Terms are governed by the laws of India, without prejudice to any mandatory consumer-protection rules of the country where you habitually reside.
• Subject to such mandatory rules, disputes shall fall under the exclusive jurisdiction of courts in Gurgaon, Haryana, India.
